Forbes, County Manager, Stanly County John Munn, County Manager, Union County FROM: }~dnderburk, Area Director DATE: February 18, 1981 ~: Name of Mental Health Program Last November we received a copy of an Attorney General's Opinion, which was requested by Dr. Morrow, Secretary of Department of Human Resources, regarding the appropriate name for local area mental health programs. Additionally, as a part of that request, the question of allocation of state and federal funds to local area authorities was addressed. A copy of the Opinion i~ attached. As you can see, the Attorney General's office has stated the opinion'that all local mental health authorities shouldformal~_be named 6~e~.Ment_al_~__Heal_~_~th Mental Retardation and Sub~a~e_~Abuse Authoritie%,~ and that state and federal ~p~opriated funds could only be made to local authorities bearing that name. The matter was referred to Mr. Ligon Bundy, attorney on the Mental Health Board, who made the following recommendation which was passed as a resolution by the Piedmont Area Mental Health Board at its last meeting on January 22, 1981. Mr. Bundy recommended that in light of the fact that our program currently receives in excess of $~ million in state funds for our three-county area, that it would not be wise to jeopardize those funds. Since the legislation has been changed since the establishment of the Piedmont Area Mental Health Program, then the Area Mental Health Board should request pennission from eacg of the Boards of County Commissioners of Cabarrus, Stanly and Union Counties, that the joint resolution dated April 1, 1974, establishing the Piedmont Area Mental Health Program be amended to change the name of the Area Mental Health Authority to "Piedmont Area Mental Health, Mental Retardation and Substance Abuse Authority." Please consider this memorandum the formal request for permission of respective Boards of Coanty Commissioners to adopt an amendment changing the name as stated above.
