aha shall be open for public inspection. <br /> <br /> (3) Alteration of Watercourses <br /> <br /> (a) Notify adjacent communities and the North Carolina Department of <br /> Natural Resources and Come, unity Development prior to any altera- <br /> tion or relocation of a watercourse, and shall submit evidence of <br /> such notification to the Federal Insurance Administration. <br /> <br /> (b) Require that maintenance is provided within the altered or relocat- <br /> ed portion of said watercourse so that the flood-carrying capacity <br /> is not diminished. <br /> <br /> (4) Use of Other Base Flood Data <br /> <br /> When base flood elevation data has not been provided in accordance with <br /> Article 3, Section B, Basis for Establishin~ Floodwavs and the Areas of <br /> S~ecial or Extreme Hazard, then the Director of Planning shall obtain, <br /> review, and reasonably utilize any base flood elevation data available <br /> from a federal, sta~e or other source, ~n order to administer Article 5, <br /> Section B of ;his ordinance. Also, when the "Floodway" has not been <br /> established by data in accordance with Article 3~ Section B, then the <br /> Director of Planning shall obtain, review, and reasonably utilize any <br /> flood elevation data available from a federal, state or other source, <br /> · n order to administer Article 5, Section B, of this ordinance. <br /> <br /> (5) Interpretation of Mapped Boundaries <br /> <br /> k%ere interpretatioa is needed as to the exact location of the boundaries <br /> identified by the Flood Hazard Boundary Maps, the Flood Inserance Rate <br /> Maps, and tile Flood Boundary-Floodway Maps (for example, where there appears <br /> to be a conflict between a mapped boundary and actual physical conditions), <br /> the Director of Planning shall make tbe necessary interpretation. <br /> <br />SECTION C. Variance Procedures <br /> <br /> (1) The Cabarrus Coonty Planning Board, as established by Cabarrus Couaty~ <br /> shall hear and decide appeals and requests for varzances from tbe re- <br /> quirements of this ordinance. <br /> <br /> (2) The Cabarrus County Planning Board shall hear and decide appeals when it <br /> is alleged there is an error in any requirements, decision, or determina- <br /> tioa made by the Cabarrus County Director of Planning in the enforcement <br /> or administration of this ordinance. <br /> <br /> (3) Any person aggrieved by tile decisioa of the Cabarrus County Planning Board <br /> or any taxpayer may appeal such decision ~o the Superior Court of Cabarrus <br /> County, as provided in North Carolina General Statutes i43-215.57. <br /> <br /> (4) Variances may be issued for the reconstruction, rehabilitation or re- <br /> storation of structures listed on the National Register of Historic <br /> Places of the State Inventory of Historic Places without regard to the <br /> procedures set forth in tile remainder of this section. <br /> <br /> (5) In passing upon such applications, tile Cabarrus County Planning Board shall <br /> consider all technical evaluations, all relevant factors, standards <br /> specified in other sections of this ordinance, and: <br /> <br /> 6 <br /> <br /> <br />
