ILLL ~esponsible Health Au~horit7 101 The facility ha~ a designated health authorit~ with responsibility for health care services pursuant to a written agreement, contract or job description. The health authority, may be a physician, health adminis- trator or agency. When this authority is other than a physician, final' medical judgments rest with a single designated ~sponsible phy- sician licensed in the state~ i[E'~IAL) Discussion: Health care is the sum of all action taken, preventive ~eutic, to provide for the physical and mental well-being of a population. Health care, among other aspects, includes medical and dental services, personal hygiene, dietary and food services, and environmental conditions. The health authority responsibility includes arranging for all levels of health care and assuring quality and accesslbility of all health services provided to inmates° It may be necessary for the facility to enter into written agreements with outside providers and facilities in order to meet all levels of care. A responsible physician is required in all instances; he or she makes the final medical Judgments, In most situations, the respon- sible physician will be the health authortty~ In many instances, the responsible physician also provides primary care. COMMENT: In most states the eheriff or warden is the person legally respon- sible for everything to do with the inmatea incleding providing adequate medical care. But elnce he ia not prepared to provide it, that authority is delegated to a health authority. The health authority'a respon~ihtlity or accountability includes arranging for a cohesive health care deliver~'system. SAMPLE WRITTEN AGREEMENT Between County Jail and , MD A. The County Jail, hereinafter for convenience referred to as "JAIL" and , MD, hereinafter for convenience referred to as "HEALTH AU%~{ORITY", enter into this AGREE- MENT on this day of , 19 ~ The JAIL contracts with the HEALTH AUTHORITY for a term of year(s) beginning on the day of , 19 and ending on the day of , 19 . The JAIL shall compensate the HEALTH AUTHORITY~for medical services rendered as billed by him. The term of this AGREEMENT shall be extended from year to'year thereafter (except as otherwise provided bereln) unless terminated by either party by written notice delivered to the other not less than 30 days prior to the termination date.
