Upon recommendation of the Building <br />Inspecto~ the Board of Cormnis~ioners may institute appropriate <br />legal action to enjoin the violation of the ordinance. <br /> <br />Section VI. Procedure for Special Use Permits <br /> <br /> The Cabarrus County Planning Board may allow the issuance <br />of Special Use Permits or exceptions for specific cases which <br />vary fCom the requirements of this ordinance, provided that <br />such variations will not have the effect of nullifying the <br />intent and purpose of these regulations The Board shall not <br />grant a Special Use Permit unless and until: <br /> <br /> 1. A written application for a Special Use Permit is <br />submitted indicating the section of this ordinance nnder which <br />a variance is sought. <br /> <br /> 2. A public hearing is held. Notice of such public <br />hearing shall be posted on the property for which a Special Use <br />Permit is sought and in a local newspaper at least 15 days prior <br />to the public hearing. This legal notice shall describe the <br />request and appear at least once weekly for two (2) consecutive <br />weeks. <br /> <br /> 3. In order to qualify for a Special Use Peri, it, the <br />applicant must satisfy the Cabarrus County Planning Board that <br />he meets the requirements of either A or B below <br /> <br /> A. Hardship. <br /> <br /> 1. Special conditions and circumstances exist which <br />are peculiar to the land, structure, or building involved and <br />which are not applicable to other lands, structures, or buildings <br />in the same neighborhood. <br /> <br /> 2. A literal interpretation of the provisions of this <br />ordinance wou%d deprive the applicant of rights commonly enjoyed <br />by other properties in the same neighborhood. <br /> <br /> 3. That granting the Special Use Permit requested will <br />not confer on the applicant any special privilege that is denied <br />by this ordinance to other lands, structures, or buildings in <br />the same neighborhood. <br /> <br /> 4. That the special conditions and circumstances do not <br />result from the actions of the applicant. <br /> <br /> B. Planned Unit Development - Planned Residential Development <br /> <br /> In the case of a unified or group residential project such <br />as multi-family dwellings where measures have been taken to: <br />insure adequate safeguards from fire, panic, and other dangers; <br />provide adequate light and air; prevent the overcrowding of land; <br />avoid undue concentration of population; and facilitate the <br />adequate provision of transportation, water, sewerage, schools, <br /> <br /> <br />
