AGREEMENT FOR MUTUAL ASSISTANCE IN LAW ENFORCEMENT <br /> <br /> BETWEEN <br /> <br /> CITY OF CONCORD AND CABARRUS COUNTY <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br /> THIS AGREEMENT entered into this llth day of March, 1971, by and between <br />the CITY OF CONCORD, Party of the First Part, and the COUNTY OF CABARRUS, Party <br />of th~ Second Part, <br /> <br /> WITNESSETH: <br /> <br /> THAT WHEREAS the General Assembly of North Carolina did enact into law <br />an act to authorize law enforcement officers of one political subdivision of <br />the State to be sent to another political subdivision of the State in'cases of <br />emergency, the same being codified as G.S. 160-20.2, as enacted by Chapter 846 <br />of the 1967 Session Laws of the General Assembly of North Carolina; and <br /> <br /> WHEREAS that act further provides that upon entering into a reciprocal <br />agreement, assistance by law enforcement officers from one political subdivision <br />may be rendered to the other political subdivision upon a proper declaration of <br />emergency by the chief elected official of the political subdivision or, in his <br />absence, the person normally acting in his stead in case of absence; and <br /> <br /> WHEREAS it is deemed to be in the public interest for the Party of the <br />First Part and the Party of the Sehond Part to enter into an agreement for <br />mutual assistance in law enforcement; <br /> <br /> NOW THEREFORE in consideration of the mutual covenants hereinafter expressed, <br />and for the purpose of furnishing mutual assistance in law enforcement, in the <br />form of law enforcement officers, other personnel, equipment, and materials, in' <br />cases of emergency, it is hereby agreed as follows: <br /> <br /> 1. Unless the context clearly requires otherwise, the following definitions <br />shall apply in interpreting this agreementf <br /> <br /> a. Chief elected official. This phrase refers to the Mayor of the <br /> Party~of the First Part and to the Chairman of the Board of County <br /> Commissioners of the Party of the Second Part. In the absence of <br /> such Mayor or Chairman, the term shall refer to the person <br /> authorized to act in his stead in case of absence. <br /> <br /> b.-~equested party. This phrase refers to a party to this agreement. <br /> which at the time in question has received a request for law <br /> enforcement assistance from the other party to this agreement. <br /> <br /> c. ~equest for law enforcement assistance. This phrase refers to a <br /> request made by the chief elected official of a requesting party <br /> to the chief elected official of a requested party that the <br /> requested party send to the requesting party one or more of the <br /> following: (1) law enforcement officers; (2) equipment, supplies, <br /> <br /> <br />
