or materials that may be of use in preserving or restoring <br /> order; (3) or other personnel, goods, or services needed by <br /> a requesting party in cases of emergency. The request may be <br /> made orally or in writing and may be delivered directly or <br /> indirectly, in person, by messenger, by telephone, by telegraph, <br /> by radio, or otherwise. If the request is made orally, it shall <br /> at the same time be reduced to writing and mailed, telegraphed, <br /> or delivered to the chief elected official o~ the requested <br /> party. The chief elected official of the requested party need <br /> not wait for the receipt of written confirmation of the request, <br /> however, before taking action. <br /> <br /> d. Req~esting party. This phrase refers to a party to this agreement <br /> which at the time in question (1) is suffering from an emergency <br /> requiring or likely to require a greater level of law enforcement <br /> effort than it can provide, (2) has, through its chief elected <br /> official, declared that a state of emergency exists, and (3) has <br /> initiated a request for law enforcement assistance from the other <br /> party to this agreement. <br /> <br /> e. Sending party, This phrase refers to a requested party which has, <br /> in the manner specified in this agreement, agreed to send part or <br /> all of the law enforcement assistance requested by the requesting <br /> party. <br /> <br /> 2. When the chief elected official of a party to this agreement determines <br />in his discretion that his political subdivision is faced with emergency conditions <br />requiring or likely to require a greater level of law enforcement effort than can <br />be provided by that subdivision, he may make a public declaration of emergency~ <br />In the case of Cabarrus County, this determination and declaration shall only be <br />made after consultation with the sheriff of the county. Upon the making of such <br />declaration, the political subdivision then becomes entitled to request law en- <br />forcement assistance as a requesting party Under the terms of this agreement. <br />The request made shall be with the concurrence of the sheriff in the case of <br />Cabarrus County, though a statement that such concurrence has been secured need <br />not be expressly made in the request for law enforcement assistance. <br /> <br /> 3. Upon receipt of a request for law enforcement assistance by the chief <br />elected official of a requested party, such chief elected official shall imm- <br />ediately, in consultation with the sheriff, in the case of Cabarrus County, <br />initiate an inquiry within his jurisdiction to determine whether the requested <br />party may honor the request for law enforcement assistance, or any part of it, <br />without unduly'impairing its capacity to maintain law and order and provide for <br />the peace and safety of its citizens and their property.- Upon his determination <br />that part or all of the request for law enforcement assistance may be honored <br />without undue danger to the requested.party, the chief elected official of the <br />requested party may take such steps as necessary to furnish as much law enforce- <br />ment assistance to the requesting party as he deems appropriate. In the case <br />of Cabarrus County, the making of that determination and the taking of any steps <br />to furnish law enforcement assistance shall be done with the concurrence of the <br />sheriff. Subject to overriding action by the governing body of the requested <br />party, and the necessary concurrence of the sheriff in the case of Cabarrus <br />County, the decision whether to send, and the timing and amount of the sending <br />of, law enforcement assistance shall be solely within the discretion of the <br />chief elected official of the requested party. <br /> <br /> <br />
