h. The special costs of any benefits, penalties, damages, <br /> or indemnities paid or payable by the sendin.~ party to its <br /> employees or others on account of the furnisMng of law <br /> enforcement assistance under this agreement. This includes <br /> such increases or estimated future increases in costs of <br /> insurance premiums as may be attributable to the furnishing <br /> of law enforcenqent assistance. Where such benefits, penalties, <br /> damages, indemnities, or other costs detailed in this agree- <br /> ment are payable by an insurer or other indemnitor, or are <br /> reimbursable to the sending party by such insurer or <br /> indemnitor (other than the requesting party), the requesting <br /> party shall not be liable except for net costs, interest payments, <br /> or other special costs actually borne by the sending party. <br /> <br /> i. The net costs of any litigation, including court costs, damage <br /> awards, and legal fees, to which the sending party is subjected <br /> on account of its furnishing law enforcement assistance under <br /> this agreement. <br /> <br /> j. Any other costs, whether direct or indirect, clearly <br /> attributable to the request for law enforcement assistance <br /> borne or to be borne by the sending party. <br /> <br /> 10. In lieu of computing the detailed costs to it of furnishing [aw <br />enforcement assistance, a sending party may, where it is more convenient to <br />do so, determine the reasonable value of the assistance rendered and submit <br />an invoice for this amount. Such invoice may also be based in part upon a <br />calculation of costs and in part upon a determination of reasonable value of the <br />assistance rendered. In any event, the invoice submitted should contain a <br />sufficient itemization of amounts charged so that the general basis for any <br />r>articular charge is reflected. <br /> <br /> 1 1. Notwithstanding any other provision of this agreement, the <br />requesting party shall not be liable to the sending party for any costs borne by <br />it on account of acts of the employees or agents of the sending party of the kind <br />set out in this paragraph. To the extent that liability attaches at all to a <br />political subdivision of the State, the sending party shall be solely liable in the <br />event of litigation or other costs arising with respect to: (1} failure of equipment <br />or other material furnished that resulted solely from negligence by employees <br />or agents of the sending party prior to the time of the request for law enforcement <br />assistance; (2) wilful misuse of equipment or other material of the sending party <br />by employees or agents of the sending party, when suchwilful conduct was in <br />no way sanctioned or commanded by any person in or apparently in authority <br />acting on behalf of the requesting party; (3) wilful and malicious misconduct of <br /> <br /> <br />
