NORTH CAROLINA <br /> <br /> CABARRUS COUNTY <br /> <br /> THIS AGREEMENT, made and entered into this 8th day of January, <br /> <br /> 1973, by and between DONALD R. STEELE, party of the first part, and <br /> <br /> CABARRUS COUNTY, party of the second part; <br /> <br /> W~T NESSE TH: - <br /> <br /> That whereas, by contract dated Jmuary 8, 1973, the'parties <br /> <br /> hereto agreed that Donald R. Steele would operate the Cabarrus County <br /> Sanitary Landfill for the period from February 1, 1973, until June 30, <br /> 1973, under the terms and co nditicns set out in said contract md made a <br /> part of this agreement; <br /> <br /> And whereas, one of the terms was that the said Donald R. Steele <br /> <br /> would furnish a satisfactory performance bond in the amount of Four <br /> Thousand Doilars ($4, 000.00); and whereas, the said Donald R. Steele has <br /> agreed to deposit the sum of Four Thousand Dollars ($4, 000.00) to secure <br /> <br /> the performance of said contract as required therein. <br /> <br /> NOW, THEREFORE, it is hereby agreed: <br /> <br /> 1. That on the 1st day of February, 1973, the sum of Six Thousanc <br /> <br /> Dollars ($6, 000.00) of the Ten Thousand Dollars ($10, 000.00) now on <br /> deposit with Citizens Natio mi Bank, Concord, North Carolina, As Trustee, <br /> will be returned to Donald R. Steele provided that he has fully complied <br /> with the contract of January 12, 1972, and that the balance of said sum, <br /> to wit: Four Thousand Dollars ($4, 000.00), shall remain on deposit with <br /> Citizens National Bank, Concord, North Carolina, a~!Trustee. <br /> <br /> 2. That the said Trustee is to hold said sum during the period <br /> <br /> of ~ contract between Cabarrus County and Donald R. Steele or until <br /> <br /> the same shall have been forfeited as herein set out. J <br /> <br /> 3. That the said Four Thousand Dollars ($4, 000.00) shall be for- <br /> <br />WILLIAMS.
