with Cabarrus County dated January 8, 1973, for the operation of the Cabarrus County Landfill and the said Trustee is hereby authorized and directed to pay said sum of money to Cabarrus County upon the due notifi- cation to said Trustee by the Health Director of Cabarrus County that he has informed the said Donald R. Steele by written notice of his non-compli- ance with the terms of said landfill operation contract hereinbefore referred to and that the said Donald R. Steele has failed within five (5) days from the date said notice was served upon him (which service may be~nade by regis- tered mail or personal service by the Sheriff of Cabarrus County) to remedy his breach of said contract to the satisfaction of the Health Director. 4. It is understood and agreed that payment by said TruStee to Cabarrus County of Four Thousand Dollars ($4, 000.00) under the provisions of Paragraph 3 hereof shall discharge said Trustee from all responsi~ity under this agreement. It is further understood that said money may be released and paid by said Trustee to either of the parties hereto upon the mutual consent of both parties. 5. It is understood and agreed that said Trustee may deposit said money in a savings account and that the interest thereon shall be plaid to Donald R. Steele, together with the principal in the event he success- fully performs said contract to operate the sanitary landfill.
