shall be measured by discharge from its wastewater- <br />treatment and disposal plant in 'Kannapolis, North <br />Carolina, and not by discharge from its plan~s'in and <br />about the City of Concord into the Board's Brey-~IcNar <br />wastewater treatment and disposal plant. The forty-one <br />and sixty-seven percent (41.67%) use of Plant capacity <br />allocated to the Board shall be measured by discharge <br />from its Brey-McNar wastewater treatment and dispo~ai <br />plant in Concord, North Carolina, (or other facility <br />accommodating the Board's effluent in the future) and <br />the sixteen and sixty-six percent (16.66%) use of Plant <br />capacity allocated to the County shall be measured by <br />all discharges throughout the area covered by the Plan <br />into the Plant other than discharges from the Cannon Mills <br />plant in Kannapolis, North Carolina referred to above and. <br />from the Board's Brey-McNar plant in Concord, North Carolina, <br />also referred to above'. <br /> <br /> The Board, the County, and Cannon Mills shall each <br /> <br />have the right (as complaining party) to enjoin any other <br />(as offending party) from discharging sewage for treatment <br />by the Plant in an amount in excess of such offending party's <br />allocated percentage, if such complaining party needs and is <br />unable to secure its allocated percentage of the plant's <br />treatment capacity and if such offending party fails to <br />correct such excess use within twenty (20) days after receipt <br />of written notice from the complaining party to all parties <br />to this Agreement and demand that such excess use cease. <br /> <br /> 9. Maintenance and Operation of Plant. The Plant <br />shall be operated and maintained by the Board in compliance <br />with all applicable standards and requirements of the United <br />States and the State. The operation and maintenance of the <br />Plant shall be financed by revenues of the entire wastewater <br />collection and treatment system of which the Plant forms a <br />part, which revenues are to be generated through fees and charges <br /> <br /> <br />
