for such compliance and shall give the Board <br /> <br /> ~he right to inspect the progress of construction <br /> <br /> from time to time at any reasonable time. <br /> <br /> 6. Changes in Plans and Specifications. The Board <br />shall agree to'no material~ changes in the plans and specifi- <br />cations for the construction of the Plan~'which have been <br />approved by the United States and the State, unless the <br />Unite~ States and the State shall approve such changes, and <br />any contract let by the Board for construction of the Plan~ <br />shall so provide. <br /> <br /> 7. Ownership of the Plant. The Board shall own " <br /> <br />the real property ~nd pe·rmanent, improvements comprising the <br />Plant and shall hold such real property and improvements <br />subject to the required uses specified in paragraph 8 of <br />this Agreement. <br /> <br /> 8. Use of Plant. During the useful life of the <br /> <br />Plant, the Board, the County, and Cannon Mills shall have the <br />right to the use of the treatment capacity of the Plant <br />according to the'following percentages: <br /> <br /> The Board · 41.67% '. <br /> <br /> .The County 16.66% <br /> Cannon Mills 41.67% <br /> <br />provided, however, that any party may 'exceed its allocated <br />percentage to the extent that the other parties are not using <br />the full percentages allocated to them; and provided.further <br />that any two parties may exceed their allocated percentages <br />if they agree to the percentage of use of such excess 'cap~city <br />or allocate equitably between them any excess capacity resulting <br />from the failure of the remaining party to utilize its full <br />percentage allocation.
