Vehicle: Every device in, upon, or by which any person or property <br />is or may be transported or drawn upon a street or highway. <br /> Parking: The stopping or standing of a vehicle, whether occupied <br />or not, otherwise than temporarily for the purpose of and while actually <br />engaged in loading or unloading. <br /> Parkin~ Spac.e: A space sufficient in size to accomodate a standard <br />automobile. <br /> Person: Any person, firm, association or corporation. <br /> Section 2. <br /> This ordinance shall apply to the County-owned property located in <br />the block bounded by Union Street, South, Means Avenue, Southeast, <br />Church Street, Southeast, and Corban Avenue, Southeast. Section 3. <br /> No vehicles shall be parked on said county property except in the <br />area at the rear of the old and new courthouses. No vehicle shall at <br />any time ben,parked on said County property in a manner that prohibits <br />any other vehicle parked on said property from being moved from its <br />parking place and provided further, that no vehicle shall be parked in <br />any manner that interferes with the flow of traffic in two directions <br />to entries and exits between said parking area and the public streets. <br /> Section 4. Penalties <br /> A. Obedience to this ordinance is chargeable to the person actually <br />operating or in control of the vehicle at the time it is parked on said <br />County property hereinbefore described; provided that proof of ownership <br />of any vehicle found parked in violation of this ordinance shall be <br />prima facie evidence that said owner parked said vehicle. <br /> B. The Sheriff of Cabarrus County, or any of his deputies or any <br />County employee authorized by the County Manager, shall caused to be <br />attached to any vehicle parked in violation of the provisions of this <br />ordinance a notice to the owner or operator thereof to report to the <br />Sheriff's Department in regard to such violation. <br /> C. Each such owner or operator may, within 24 hours of the time <br />when such notice was attached to such vehicle, submit to the violation <br />and pay as penalty in full satisfaction of such violation, the sum <br />of $5.00. The failure of such owner or operator to make such payment <br />of said amount, within said 24 hours, shall render such owner or <br />operator subject to punishment for a misdemeanor as hereinafter provided. <br /> D. The violation of any of the p~visions of this ordinance shall be <br />a misdemeanor and punished by fine not to exceed Fifty Dollars ($50.00) <br />or imprisonment not to exceed thirty (30) days, or by both such fine <br />and imprisonment in the discretion of the Court. <br /> E. Any vehicle parked in violation of this ordinance may be <br />removed from the property by Cabarrus County or any agent of Cabarrus <br />County to a storage area or garage. If a vehicle is so removed, the <br />owner, as a condition of regaining possession of said vehicle shall be <br />required to pay to Cabarrus County all reasonable costs incidental to <br />the removal and storage of the vehicle. <br /> F. The Deputy Sheriff on duty at the Cabarrus County Sheriff's <br />Department shall accept designated penalties and issue receipts. The <br />said Deputy. Sheriff or any employee in the County Manager's Office may <br />accept the costs to the County incidental to the removal and storage <br />of said vehicle. Section 5. <br /> This ordinance shall apply between the hours of 8:00 A.M. and <br />5:00 P.M. Monday through Friday of each week. <br /> Section 6. <br /> This ordinance shall be in full force and effect from and after <br />the 6th day of January, 1977. <br /> <br /> Commissioner McClary made motion to reappoint Jack Cranford to the COG <br />Manpower Advisory Committee.
