Attorney John Boger presented a proposed Ordinance Regulating Places of <br />Amusement. After a disc~sion, several minor changes were made. Commissioner <br />Hamm~t~ made motion to adopt the ordinance as amended. Commissioner Cook <br /> <br />seconded the motion and vote car~ed. The adopted ordinance is as fo~ows: <br /> <br /> BE IT ORDAINED by the Board of Commissioners of <br />Cabarrus County, North Carolina, that the following ordinance <br />be and the same is hereby adopted: <br /> <br />Section I. It shall be unlawful for any person, fi~m or <br />corpor~on to operate a pool or b~d room where more <br />than ten (10) pool or bd~d or bagatelle table~ or tables <br />of like character are kept for rent or h~e or for any other <br />compensation, directly or indirectly. <br /> <br />Section 2. No pool or billiard room or establishment shall <br />be operated later than 11 o'clock p.m. on Mondays, Tuesdays, <br />Wednesdays, or Thursdays, or later than 11: 30 .o ' clock p.m. <br />on Fridays or Saturdays. No pool or billiard room establish- <br />ment sh~ll be operated on Sundays. <br /> <br />Section 3. It shall be unlawful for any owner, manager, or <br />person in charge of a pool or billiard room or establishment <br />to a~low gambling or the consumption of any a~coholic beverage <br />upon the premises of such e~£ablishment. <br /> <br />Section 4. (a) No person under eighteen (18) year~ of'age <br />shall b'e allowed to enter or loiter in a poolroom where any <br />billiard, pool or bagatelle table or tables of like character <br />are kept for rent or hire, or for compensation directly or <br />ind~ectly. No owner, manager, or per~on in charge of a <br />pool or bil~d room where a table is kept for the purpose <br />specified herein, violating any provisions of this section by <br />a~lowing persons under eighteen (18) ye~s of age to enter <br />such poolrooms, and any person under eighteen (18) years of <br />age violating any provisions of this section shall be guilty <br />o f a misdemeanor. <br /> <br /> (b) No owner, manager, or person in charge of <br />any poolroom or billiard pa~lor sha~l admit any minor under <br />eighteen (18) years of age unless said minor shall be accompanied <br />by h~s or her parent or legal guardian. <br /> <br /> (c) A copy of th~ section shall be conspi¢iously <br />posted in every poolroom and billiard parlor. <br /> <br />Section 5. It shall be unlawful for any person to place or .keep <br />any k~nd o4 stain, paint, c~rtains or other things on or in front <br />of any glass which obscures the view into any place or building <br />where a poolroom is maintained. <br /> <br />Section 6. (a) Any person violating the provisions of this <br />ordinance shall be guilty of a misdemeanor and upon conviction <br />may be punished by a fine not to exceed Fifty Dollars ($50.00) or <br />imprisoned for a period not to exceed thi~y (30) days or by both <br />such fine and imprisonment. <br /> <br /> (b) The Board of Commissioners of Cabarrus County may <br />take civil action, including the application for injunctive relief, <br />against any person violating the provisions of this ordinance. <br /> <br /> Section 7. This ordinance shall be in full force and effect from <br /> and after the Ist day of May, 1977. <br /> <br /> "The undersigned Fire Protection Commissioners of the Harrisburg Fire <br />District do recommend that the Harr~burg Fire District be extended to include <br />the area set forth in the boundary discription advertised for the hearing at <br />the March meeting of the Cabar~us County Commissioners. <br /> <br /> <br />
