253 <br /> <br /> (r) Areas to be used for purposes other than re- <br /> sidential, if any, with the purpose, location <br /> and dimension of emch indicated; <br /> (s) The available flood data for the area to be <br /> subdivided. <br /> 8. If the final plat is disapproved by the Planning <br /> Board, the reasons for disapproval shall refer speci- <br /> fically to those parts of the ordinance or regulations <br /> with which the plat does no~ comply. One copy of such <br /> reasons with the film or linen plat and one print of the <br /> proposed subdivision plat shall be returned to the sub- <br /> divider. One copy shall be retained by the Planning <br /> Board. Before final approval is granted, the subdivider <br /> shall make the required changes and submit a revised plat. <br /> 9. The Planning Board shall review the final plat for <br /> compliance with the requirements of this ordinance, and <br /> any other specifications which were agreed upon at the time <br /> of review of the preliminary plat. The Planning Board <br /> shall have five (5) working days after the proper sub- <br /> mission of the final plat to the Planning Department to <br /> take action on the final plat. Unless stipulation for <br /> additional time is agreed to by the subdivider and if <br /> the Planning Board fails to take action in the allotted <br /> time, the subdivider may demand a certificate of approval <br /> on the reproducible copy of the final plat signed by the <br /> Chairman of the Planning Board. <br /> 10. When the Planning Board approves the final plat, such <br /> approval shall be indicated on the reproducible copy of <br /> the final plat by the signature of the Chairman of the <br /> Planning Board on the Certificate of Approval. <br /> 11. Street Signs: <br /> (a) The County shall bear the cost of installing <br /> street signs at all intersections as shown <br /> on the final plat. <br /> 12.. Decisions of the Planning Board may be appealed <br /> to.the Board of County Commissioners. <br /> Section E. Recording of Final Plat <br /> 1. After the affixing of all required signatures (except <br /> Certificate of Registration by the Register of Deeds) the <br /> final plat shall be returned to the subdivider. The <br /> subdivider shall file the approved final plat, on a sheet <br /> size as required by the Register of Deeds, with the Reg- <br /> ister of Deeds of Cabarrus County for recording within <br /> ninety (90) days of the date of its approval by the Plan- <br /> ning Board or such approval shall be void unless an ex- <br /> tension of time is granted by the Planning Board. <br />ARTICLE IV. ADMINISTRATION <br /> Section A. Variances <br /> l. The Planning Board may approve subdivision plats which <br /> vary from the requirements of design, but not of proced- <br /> ure or improvement. Such a variance may be granted only <br /> where topographic or other existing physical conditions <br /> are such that compliance with the requirements of this <br /> ordinance would cause an unusual and unnecessary hard- <br /> ship on the subdivider above and beyond what other sub- <br /> dividers would meet, and provided that such variations <br /> will not have the effect of nullifying the interest and <br /> purpose of these regulations. <br /> 2. The subdivider must submit a written request stating <br /> the reasons for each modification. These modifications <br /> shall be included in the ~Subdivision Improvement Dis- <br /> closure Statement." <br /> 3. Any modifications thus authorized are required to be <br /> entered in writing in the minutes of the Planning Board <br /> and the reasoning on which the departure was justified <br /> set forth. The Board of Commissioners shall then be <br /> notified in writing of the variance or exception granted. <br /> Section B. Planned Unit Development <br /> 1. The standards and requirements of this ordinance may <br /> be modified by the Planning Board in the case of a plan <br /> and program for a group, cluster, or planned unit devel- <br /> opment, which, in the judgement of the Planning Board, <br /> provides adequate public spaces and improvements for cir- <br /> culation, recreation, light, air, and service needs of <br /> <br /> <br />
