254 <br /> <br /> the tract when fully developed and populated, which <br /> also provides such covenants or other legal provisions <br /> as will assure conformity to and achievement of the <br /> Land Development Plan. <br /> Section C. Public Sites and Open Spaces <br /> 1. When a tract of land to be subdivided embraces any <br /> part of a proposed major or minor thoroughfare, parkway, <br /> or boulevard designated on Official Maps and/or Plans, <br /> the proposed way shall be plotted by the subdivider in <br /> the location and at the width specified, <br /> Section D. Registration of Ordinance and Plats <br /> 1. The Board of County Commissioners of Cabarrus County <br /> shall file a copy of this ordinance with the Register of <br /> Deeds of Cabarrus County. <br /> 2. The Register of Deeds shall not thereafter file or <br /> record a plat of a subdivision located within the ter- <br /> ritorial jurisdiction of Cabarrus County without the <br /> approval of the Cabarrus County Planning Board as re- <br /> quired by this ordinance. <br /> 3. The landowner shown on a subdivision plat submitted <br /> for recording or his authorized agent, shall sign a <br /> statement on the plat as to whether or not any land <br /> shown thereon is within the territorial jurisdiction of <br /> Cabarrus County as defined herein. <br />ARTICLE V. LEGAL PROVISIONS Section A. Separability <br /> 1. Should any section or provision of these regulations <br /> be for any reason held invalid by any court of law, such <br /> action shall not affect the validity of any other section <br /> or provision hereof which is not itself invalid. <br /> Section B. Conflict <br /> 1. When the requirements of this ordinance conflict <br /> with the requirements of other lawfully adopted rules, <br /> regulations, or ordinances of Cabarrus County, or deed <br /> restrictions imposed by the developer, the more stringent <br /> or higher requirements shall govern, <br /> Section C. Penal~y <br /> 1. After the effective date of this ordinance, any per- <br /> son who, being the owner or agent of the owner of any <br /> land located within the territorial jurisdiction of <br /> this ordinance, thereafter subdivides his land in vio- <br /> lation of this ordinance, shall be guilty of a misdemeanor. <br /> 2. If any person violates any provision of this ordinance, <br /> he shall be guilty of a mimdemeanor and shall be fined <br /> not more than fifty dollars ($50.00) or imprisoned for <br /> not more than thirty (30) days. <br /> Section D. Amendments <br /> 1. The Cabarrus County Board of County Commissioners <br /> may from time to time amend these regulations, but no <br /> amendment shall become effective unless it shall have <br /> been submitted to the Planning Board for review and <br /> recommendations. <br />ARTICLE VI. MINIMUM STANDARDS OF DESIGN Section A. General <br /> The following design standards shall be minimum require- <br /> ments; where other official engineering and public works <br /> standards and specifications are more stringent, such <br /> higher standards shall be used. <br /> (a) Alleys are not permitted in residential districts <br /> except when the Planning Board determines special <br /> conditions warranting a secondary means of access. <br /> (b) Street jogs with centerline offsets of less than <br /> one hundred twenty-five (25) feet shall be prohibited. <br /> Section B. Streets and Roads <br /> 1. The design of all streets and roads within the jur- <br /> isdiction of Cabarrus County shall be in accordance with <br /> the accepted policies of the North Caroiina Department <br /> of Transportation, Division of Highways. The manual on <br /> "Subdivision Roads - Requirements and Minimum Construction <br /> Standards" shall be the standards for Cabarrus County. <br /> Section C. Sewage Requirements <br /> 1. Sewage Disposal: Either written or drawn plans for <br /> disposal of sewage from the subdivision shall accompany <br /> the submission of the preliminary and final plats. These <br /> <br /> <br />
