The following are the minimum setback distances: <br /> (a) Front yard - Twenty-five (25) feet from right-of- <br /> way line. <br /> (b) Side yard - Ten (10) feet from side yard <br /> property line. <br /> (c) Rear yard - Twenty-five (25) feet from rear <br /> yard property line. <br />ARTICLE VII. IMPROVEMENTS Section A. General <br /> 1. Subdivisions may be developed by sections, Each <br /> section shall be submitted as a final plat to be re- <br /> corded in the office of the Register of Deeds, after <br /> approval by the Planning Board. <br /> 2. Improvements shall be installed in accordance with the <br /> requirements and standards set forth in this ordinance <br /> and other specifications and policies of Cabarrus County. <br /> Ail improvements shall be inspected and approved by the <br /> Planning Department. <br /> Section B. Required Improvements <br /> 1. Markers: Permanent concrete markers, property <br /> corner ties and lot corners shall be in compliance with <br /> the latest North Carolina Manual for Land Surveying. <br /> 2. Streets: The subdivider sh~ll submit to the Planning <br /> Board along with the final plat a Certificate of Approval <br /> of Streets and Street Drainage Plans signed by the Dis- <br /> trict Engineer, North Carolina Department of Transportation. <br /> 3. Surface Water Drainage: The subdivider shall do all <br /> grading and install all drainage structures shown on <br /> the final plat. <br /> Section C. Optional Improvements <br /> 1. Private streets in lieu of public streets; <br /> 2 Parks; <br /> 3 Playgrounds; <br /> 4 Swimming pools; <br /> 5 Sports facilities; <br /> 6 Walkways; <br /> 7 Private water and sewer systems; <br /> 8. Any other improvements shown on the final plat which <br /> are for the benefit or use of all residents of the <br /> subdivision, and are not required by any County, State or <br /> Federal agencies. <br /> Section D. Subdivision Improvement Disclosure Statement <br /> <br />1. Prior to entering any agreement or any conveyance <br />with any prospective buyer, the developer and/or seller <br />shall prepare and sign, and the buyer of the subject <br />real estate shall receive and sign an. acknowledgement <br />of receipt of a separate instrument known as the Sub- <br />division Improvement Disclosure Statement, <br />2. Said Disclosure Statement shall describe all optional <br />improvements shown on the final plat or plats. The <br />developer and/or seller shall include in the Disclosure <br />Statement an explanation of the consequences and res- <br />ponsibility as to maintenance of all improvements and <br />shall fully and accurately disclose the party or parties <br />upon whom construction and maintenance of such improve- <br />ments shall rest~ <br />3. The Disclosure Statement shall contain a duplicate <br />original which shall be given to the buyer, Written <br />acknowledgement of receipt of the Disclosure Statement <br />by the buyer shall be conclusive proOf of the delivery <br />thereof. <br />4. The County of Cabarrus shall provide the subdivider <br />with blank forms of the Subdivision Improvement Disclosure <br />Statement for each lot shown on the final plat. <br />5. If any person violates any provision of this section, <br />he shall be guilty of a misdemeanor as specified in <br />Article V, Section C. of this ordinance~ <br /> <br /> <br />
