338 <br /> <br />2. Minimum depth for lots shall be 80 feet. <br /> <br /> 3. Minimum width for spaces shall be 20 feet plus width of unit <br />occupying space. <br /> <br /> 4. Minimum lot width at building setback line for multi-family, <br />individual ownership shall be 20 feet. <br /> <br /> 5. Minimum depth for spaces shall be 40 feet plus length of unit <br />occupying space. <br /> <br /> 3. Where septic tanks with drain fields are to be used to dispose of the <br />sewage, the length of nitrification lines for a residential unit shall not be <br />less than the size determined to be adequate by the Cabarrus County Health <br />Department after investigation of soil conditions, proposed individual disposal <br />system, and depth of ground water. <br /> <br /> 4. Every lot or space for residential type development located on a public <br />watershed as defined by the Cabarrus County Board of Health shall have sufficient <br />area to meet the County Health Standards and State Board of Health requirements. <br /> <br />Section V: Enforcement <br /> <br /> The Cabarrus County Building Inspector or his authorized agent shall be <br />charged with the responsibility of enforcing this ordinance in accordance with <br />the General Statutes 153 (356-363) and with issuing the permits as required by <br />this ordinance. Decisions of the Building Inspector may be appealed to the <br />Board of County Commissioners, decisions of the Board of Cabarrus County Com- <br />missioners may be appealed to the Superior Court of the County of Cabarrus, <br />North Carolina. Upon recommendation of the Building Inspector, the Board of <br />Commissioners may institute appropriate legal action to enjoin the violation <br />of the ordinance. <br /> <br />Section VI. Procedure for Special Use Permits <br /> <br /> The Cabarrus County Planning Board may allow the issuance of Special Use <br />Permits or exceptions for specific cases which vary from the requirements of <br />this ordinance, provided that such variations will not have the effect of nul- <br />lifying the intent and purpose of these regulations. The Board shall not <br />grant a Special Use Permit unless and until: <br /> <br /> 1. A written application for a Special Use Permit is submitted indicating <br />the section of this ordinance under which a variance is sought. <br /> <br /> 2. A public hearing is held. Notice of such public hearing shall be <br />posted on the property for which a Special Use Permit is sought and in a local <br />newspaper at least 15 days prior to the public hearing. This legal notice shall <br />describe the request and appear at least once weekly for two (2) consecutive <br />weeks. <br /> <br /> 3. In order to qualify for a Special Use Permit, the applicant must <br />satisfy the Cabarrus County Planning Board that he meets the requirements of <br />either A or B below. <br /> <br />A. Hardship. <br /> <br /> 1. Special conditions and circumstances exist which are peculiar to the land, <br />structure, or building involved and which are not applicable to other lands, <br />structures, or buildings in the same neighborhood. <br /> <br /> 2. A literal interpretation of the provisions of this ordinance would de- <br />prive the applicant of rights commonly enjoyed by other properties in the same <br />neighborhood. <br /> <br /> 3. That granting the Special Use Permit requested will not confer on the <br />applicant any special privilege that is denied by this ordinance to other lands, <br />structures, or buildings in the same neighborhood. <br /> <br /> 4. That the special conditions and circumstances do not result from the <br />actions of the applicant. <br /> <br />B. Planned Unit Development - Planned Residential Development <br /> <br /> In the case of a unified or group residential project such as multi-family <br />dwellings where measures have been taken to: insure adequate safeguards from <br />fire, panic, and other dangers; provide adequate light and air; prevent the over- <br />crowding of land; avoid undue concentration of population; and facilitate the <br />adequate provision of transportation, water, sewerage, schools, parks, and other <br /> <br /> <br />
