535 <br /> <br /> Upon questioning by Commissioner Lentz regarding the use of this <br />5 percent contribution to the special annuity fund, Mr. Charles McGinnis <br />explained that the entire 5 percent contribution would go in a special <br />retirement fund for the law enforcement officers in the Cabarrus County <br />Sheriff's Department and Kannapolis Police Department and would involve no <br />other County employees. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Nash and <br />unanimously carried, the Board reappointed Mr. Terry L. Rowland as Cabarrus <br />County Tax Spervisor for a two-year term in accordance with G.S.105-294. <br /> The oath of office for Tax Supervisor as sworn to and subscribed before <br />the Clerk to the Board of Commissioners is as follows. <br /> <br /> I, Terry L. Rowland, do solemnly swear (or affirm) that I will support <br />and maintain the Constitution and laws of the United States, and the <br />Constitution and laws of North Carolina not inconsistent therewith, and that <br />I will faithfully discharge the duties of my office as tax supervisor of <br />Cabarrus County, North Carolina, and that I will not allow my actions as <br />tax supervisor to be influenced by personal or political friendships or <br />obligations, so help me God. <br /> <br />Sworn to and subscribed before me this <br /> 8th day of June , 19 81. <br /> <br />/s/ Terry L. Small <br /> <br />CLERK TO THE BOARD <br /> <br /> Commissioner Lentz made motion, seconded by Commissioner Nash, to reappoint <br />Mr. Ray McKinney as Cabarrus County Tax Collector for a two-year term. <br /> The substitute motion made by Chairman Bonds to appoint Mr. Ray McKinney <br />as Tax Collector provided that he will comply with G.S. 159-32 to make deposits <br />daily and that if he does not comply with this statute he will resign immediately <br />failed for lack of second. <br /> The substitute motion made by Commissioner Cook to appoint Mr. Ray McKinney <br />as Cabarrus County Tax Collector with the understanding that the Board expects <br />him to carry out North Carolina law to the full extent as well as the wishes <br />of the Cabarrus County Board of Commissioners failed for lack of second. <br /> Commissioner Payne stated opposition to the reappointment of Mr. Ray <br />McKinney with or without stipulations to the appointment as he explained the <br />law states what Mr. McKinney is supposed to be doing in carrying out his duties <br />as tax collector. <br /> UPON MOTION of Commissioner Lentz, seconded by Chairman Bonds with <br />Commissioners Lentz, Nash, and Cook and Chairman Bonds voting for and Commissioner <br />Payne voting against, the Board amended previous motion regarding appointment <br />of Tax Collector to make the appointment for a one-year term. <br /> UPON AMENDED MOTION of Commissioner Lentz, seconded by Commissioner Nash <br />with Commissioners Lentz, Nash, and Cook and Chairman Bonds voting for and <br />Commissioner Payne voting against, the Board appointed Mr. Ray McKinney as <br />Caharrus County Tax Collector for a one-year term ending June 30, 1982. <br /> The oath of cffice for Tax Collector as sworn to and subscribed before the <br /> Clerk to the Board of Commissioners is as follows. <br /> <br /> I, Ray McKinney, do solemnly swear (or affirm) that I will support and <br />maintain the Constitution and laws of the United States, and the Constitution <br />and laws of North Carolina not inconsistent therewith, and that I will faith- <br />fully discharge the duties of my office as tax collectcr of the County of <br />Cabarrus, North Carolina, and that I will not allow my actions as tax collector <br />to be influenced by personal or political friendships or obligations so help <br />me God. <br /> <br />Sworn to and subscribed before me this <br />4th day of June , 1981 <br /> <br />/s/ Ray McKinney <br /> RAY MCKINNEY, <br /> <br />/s/ Frankie F.
