535 Upon questioning by Commissioner Lentz regarding the use of this 5 percent contribution to the special annuity fund, Mr. Charles McGinnis explained that the entire 5 percent contribution would go in a special retirement fund for the law enforcement officers in the Cabarrus County Sheriff's Department and Kannapolis Police Department and would involve no other County employees. UPON MOTION of Commissioner Cook, seconded by Commissioner Nash and unanimously carried, the Board reappointed Mr. Terry L. Rowland as Cabarrus County Tax Spervisor for a two-year term in accordance with G.S.105-294. The oath of office for Tax Supervisor as sworn to and subscribed before the Clerk to the Board of Commissioners is as follows. I, Terry L. Rowland, do solemnly swear (or affirm) that I will support and maintain the Constitution and laws of the United States, and the Constitution and laws of North Carolina not inconsistent therewith, and that I will faithfully discharge the duties of my office as tax supervisor of Cabarrus County, North Carolina, and that I will not allow my actions as tax supervisor to be influenced by personal or political friendships or obligations, so help me God. Small CLERK TO THE BOARD Commissioner Lentz made motion, seconded by Commissioner Nash, to reappoint Mr. Ray McKinney as Cabarrus County Tax Collector for a two-year term. The substitute motion made by Chairman Bonds to appoint Mr. Ray McKinney as Tax Collector provided that he will comply with G.S. 159-32 to make deposits daily and that if he does not comply with this statute he will resign immediately failed for lack of second. The substitute motion made by Commissioner Cook to appoint Mr. Ray McKinney as Cabarrus County Tax Collector with the understanding that the Board expects him to carry out North Carolina law to the full extent as well as the wishes of the Cabarrus County Board of Commissioners failed for lack of second. Commissioner Payne stated opposition to the reappointment of Mr. Ray McKinney with or without stipulations to the appointment as he explained the law states what Mr. McKinney is supposed to be doing in carrying out his duties as tax collector. UPON MOTION of Commissioner Lentz, seconded by Chairman Bonds with Commissioners Lentz, Nash, and Cook and Chairman Bonds voting for and Commissioner Payne voting against, the Board amended previous motion regarding appointment of Tax Collector to make the appointment for a one-year term. UPON AMENDED MOTION of Commissioner Lentz, seconded by Commissioner Nash with Commissioners Lentz, Nash, and Cook and Chairman Bonds voting for and Commissioner Payne voting against, the Board appointed Mr. Ray McKinney as Caharrus County Tax Collector for a one-year term ending June 30, 1982. The oath of cffice for Tax Collector as sworn to and subscribed before the Clerk to the Board of Commissioners is as follows.
