579 <br /> <br /> Members of the Board requested information from Mr. Don Goins pertaining <br />to the resurfacing of Gold Hill Road and State Road 1002, the replacement of <br />a culvert on Miami Church Road, the upgrading of railroad crossings in the <br />County, and the need f6r protective railings on several bridges on Highway 29. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Lentz and <br />unanimously carried, the Board adopted the following ordinance. <br /> <br /> BE IT ORDAINED by the Board of Commissioners for Cabarrus County pursuant <br />to the provisions of North Carolina General Statutes 153A-121(a): <br /> <br /> I. That Ethel A. Honeycutt, 613 Fairview Street, Kannapolis, North <br />Carolina, has created and is maintaining a nuisance at her home on Fairview <br />Street in Kannapolis and said nuisance is defined and described as follows: <br /> <br /> A. Ms. Honeycutt keeps a large number of dogs at her house and <br />the manner of keeping and maintaining said dogs is detrimental to the health, <br />safety or welfare and the peace and dignity of Mrs. Honeycutt, her neighbors <br />and the community for the following reasons: <br /> <br /> 1. The eight or. more dogs are kept and housed in the house <br />of Ms. Honeycutt causing health problems and distasteful odors <br />for the neighbors. <br /> <br /> 2. The dogs have attacked and bitten persons in the public <br />streets and on their own property. <br /> <br /> 3. The dogs have chased and threatened children and adults <br />using the public streets so that many persons are afraid to use <br />the streets. <br /> <br /> 4. Persons have had to shoot some of the dogs to protect <br />themselves and their property, <br /> <br /> 5. A number of the dogs have sarcoptic mange which creates <br />a health hazard. <br /> <br /> 6. The dogs have attacked and injured animals owned by other <br />persons. <br /> <br />~ 7. Records for rabies shots for the dogs are not kept or <br />available and there is reason to believe that many, if not all, <br />of the dogs have not received~inoculation for rabies. <br /> <br /> B. Ms. Honeyeutt's house and lot is kept and maintained in a manner <br />that is detrimental to'.the health, safety or welfare and the peace and dignity <br />of her neighbors and the community for the following reasons: <br /> <br /> 1. The inside of the house is piled high with boxes, papers, <br />and other trash. <br /> <br /> 2. The house has a bad odor becuase of the dogs and their <br />elimination. <br /> <br /> 3. Windows have been knocked out and the house has little, if <br />any, heat. <br /> <br /> 4. The yard of the house is grown up with grass and weeds. <br /> <br /> Iii The Board of Com~.issioners ordains that a civil action abating said <br />nuisance created and maintained by Ethel A. Honeycutt be instituted by <br />Cabarrus County and directs and empowers the Chairman of the Board, the County <br />Manager and the County Attorney to take the action necessary to abate said <br />n~isance, including requests to the court that the dogs be permanently removed <br />from Ms. Honeycutt's premises, that she be enjoined from acquiring other dogs, <br />and that representatives of 'the Health Department and Department of Social <br />Services be allowed to inspect Ms. Honeycutt's home. <br /> <br /> Mr. John Boger, County Attorney, informed the Board that this type of <br />civil action against~ Ms. Ethel Honeycutt was not covered by the retainer <br /> <br /> <br />
