37 <br /> <br /> stating that the building permit would be declared "null and void" if the <br /> Zoning Ordinance was passed. Mr. Spainhour requested that administrative <br /> action be taken at this time to revoke the permit as contemplated in the <br /> signed "statement of understanding". <br /> Mr. John Boger, Jr., County Attorney, advised that the Zoning Ordinance <br />as enacted by the Board authorized the Zoning Administrator to take action <br />as necessary to enforce the ordinance. He reviewed the course of action as <br />recommended by Mr. Richard Ducker of the Institute of Government for the <br />Zoning Administrator to follow in handling the cases in which a building <br />permit had been issued with a signed statement that the proposed structure <br />and/or use was not in compliance with the proposed ordinance. According <br />to Mr. Boger, proper action by the Zoning Administrator would involve <br />notification in writing to the property owners of the adoption of the <br />ordinance and the intention to revoke the permit unless the property owner <br />could show good cause why the permit should not be revoked. If the permit <br />is revoked by the Zoning Administrator, the property owner may then appeal <br />to the Zoning Board of Adjustment. Mr. Boger noted that there were a number <br />of permits which had been issued with the "statement of understanding" and <br />which were now in violation of the Zoning Ordinance. <br /> Mr. F. E. Isenhour, Jr., Zoning Administrator, asked the Board's <br />direction in handling those cases which involve the signed "statement of <br />understanding" and are in violation of the ordinance. No action was taken <br />by the Board in this matter. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Payne and <br />unanimously carried, the Board approved the addition of Manassas Drive to <br />the state road system. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Lentz and <br />unanimously carried, the Board set a public hearing for 10:00 A.M. on <br />March 1, 1982, for the renaming of Cardinal Avenue to Trotters Ridge. <br /> Commissioner Cook made motion, seconded by Commissioner Lentz, to <br />adopt the board fee for the Board of Adjustment at $15.00 per member and <br />$20.00 for the Chairman for attendance at each meeting and to appropriate <br />$7,901.67 from the Commissioners' Contingency Fund to Zoning Administration <br />Department. <br /> UPON SUBSTITUTE MOTION of Commissioner Payne, seconded by Chairman Bonds <br />and unanimously carried, the Board set the payment for members of the Board <br />of Adjustment at $25.00 per member and $30.00 for the Chairman for attendance <br />at the Board of Adjustment meetings and appropriated $8,301.67 from the <br />Commissioners' Contingency Fund to the Zoning Administration Department. <br />It was noted that the alternate members of the Board of Adjustment would <br />be paid the same as the regular members for their attendance at the meetings <br />of that Board.
