¸6O <br /> <br /> MEMORANDUM OF AGREEMENT <br /> BETWEEN <br /> COUNTY OF CABARRUS <br /> AND THE <br />NORTH CAROLINA WILDLIFE RESOURCES COMMISSION <br /> <br />THIS AGREEMENT, made and entered into this 16th day of March, 1982, by and between <br />the County of CABARRUS, North Carolina, hereinafter called the County, and the <br />North Carolina Wildlife Resources Commission, hereinafter called the Commission; <br /> WITNESSETH: <br />WHEREAS, the said Commission is authorized to conduct a program of fish manage- <br />ment for the ultimate benefit of the sportsmen of North Carolina; and <br />WHEREAS, it is desirable for the Commission to conduct part of its fisheries <br />studies on Frank Liske Park lake owned and controlled by said County; and <br />WHEREAS, the said County has offered to make available to the Commission Frank <br />Liske Park lake for implementing a continuing program of fishery management <br />that will not conflict with the primary purpose and use of this lake; <br /> NOW, THEREFORE, in consideration of the mutual advantages likely to result <br /> from the Agreement and the respective obligations assumed herein, <br /> THE COMMISSION AGREES: <br /> 1. To provide the technical assistance required to develop a fish-management <br /> program for Frank Liske Park lake for review and adoption by the County. <br /> 2. To compile, analyze and evaluate data resulting from the program <br /> in the form of an annual report to the County. <br /> THE COUNTY AGREES: <br /> 1. To make available to the Commission for a fisheries management pro- <br /> gram Frank Liske Park lake located in 12 township, Cabarrus County, North <br /> Carolina. <br /> 2. To follow with no deviations, Commission recommendations on all phases <br /> of fisheries management applicable to said lake which may include, but not <br /> be limited to, removal of predator, forage, and undesirable species of fish, <br /> restocking, harvest, creel and size limits, and all other management practices <br /> not incompatible with the primary purposes of the lake as may be recommended <br /> by authorized Division personnel as part of a project to manage the lake and <br /> to produce more game fish for the angler. <br /> 3. To provide the~manpower necessary to carry out the basic management <br /> plan proposed by the Commission. <br /> 4. To permit ingress, egress and regress to Commission personnel <br /> engaged in collecting and evaluating management practices applied in accordance <br /> with the basic plan. <br /> 5. To collect valid and complete catch data when deemed necessary by the <br /> Commission, and to maintain this information on forms provided by the Commission <br /> for analysis by the Commission. <br /> 6. To ensure proper recognition is given the Wildlife Resources Commission <br /> in all brochures, advertisements, etc. concerning recreational fishing in the <br /> managed lake. <br /> 7. To permit fishing by the general public, without discrimination and <br /> on a schedule consistent with the Wildlife Commission Regulations, the primary <br /> water-use function of the reservoir, and the Commission biologist's management <br /> recommendations. <br /> 8. To provide the Commission with an annual statement of fishing related <br /> receipts and expenditures and to ensure that no profit (i.e. receipts greater <br /> than expenditures) will be realized through fishing fees charged by the county. <br /> IT IS MUTUALLY AGREED: <br /> 1. That this Agreement shall become effective as soon as signed by <br /> both parties and shall continue in force until terminated by either party <br /> upon 60 days notice in writing to the other of intention to terminate upon <br /> an indicated date. <br /> 2. That fishing licenses, as required by State law, shall be jointly <br /> publicized and enforce. <br /> 3. That nothing in this Agreement shall obligate either party to any <br /> conditions not specifically stated herein. <br /> IN, WITNESS WHEREOF, the parties hereto have executed this Agreement the day <br /> <br />and year first written above. <br /> <br />Approved and agreed to: <br /> Cabarrus <br /> County <br /> /s/ Ralph C.
