61 <br /> <br /> The Board reviewed the proposed Agreement which would allow the <br />United States Naval Reserve to provide personnel to administer various <br />projects over the next several months at Frank Liske Park. Under this <br />agreement, the Naval Reserve Personnel would construct several structures at <br />Frank Liske Park including picnic tables, picnic shelters, general landscaping, <br />etc. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Lentz and <br />unanimously carried, the Board agreed by resolution to enter into the <br />following contract with the United States Naval Reserve to provide work <br />at the Frank Liske Park and authorized the County Manager to take necessary <br />action to provide the insurance coverage as specified in the contract. <br /> <br />WHEREAS, the United States Naval Reserve, through Group Active Duty for <br />Training Orders or multiple drills, has made available to Cabarrus County <br />a non-profit organization of a charitable, welfare, humanitary, civic, or <br />recreational character, certain Naval Reserve personnel to be used in connection <br />with construction work sponsored by the said Cabarrus County, said Cabarrus <br />County does hereby agree in consideration of the use of said personnel, <br />to indemnity and save harmless the United States Government its officers, <br />agents, or employees, against any and all liability including injury to <br />persons, property or for death arising either directly or indirectly out <br />of the performance of service for the said Cabarrus County by the said Naval <br />Reserve personnel. <br /> <br />FURTHER, the said Cabarrus County understands that the United States will <br />supply no materials, and assumes no respnsibility for the (1) completion <br />of any work begun by the said Naval Reserve personnel under said Group <br />Active Duty for Training Orders, or multiple drills, not for the (2) manner <br />of the work performed; and the said Cabarrus County agrees to indemnity and <br />save harmless the United States its officers, agents, or employees, against <br />any and all liability, loss or damage for the failure to (3) complete any <br />work begun by its Naval Reserve personnel or for the manner of the work done <br />by said personnel. <br /> <br />FURTHER, the said Cabarrus County agrees to provide indemnity insurance <br />coverage in an amount not less than $50,000/$100,000 against any and all <br />claims for death, personal injury or property damage arising out of <br />performance of services for the said Cabarrus County by the said Naval <br />Reserve personnel. <br /> <br /> By <br />Title <br /> <br /> CABARRUSCOUNTY <br /> <br />/s/ Ralph C. Bonds <br />Chairman of the Board of Commissioners <br /> <br /> The Board agreed to meet with the Parks and Recreation Advisory <br />Commission at 5:30 P.M. on Tuesday, March 23, 1982, at the Frank Liske Park <br />for dinner. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Lentz and <br />unanimously carrid, the Board adopted the following contract between Duke <br />Power and Cabarrus County and authorized Chairman Ralph Bonds to execute <br />the conditional right-of-way agreement with Duke Power Company to provide <br />electrical power service to the Frank Liske Park. <br /> <br />NORTH CAROLINA ) <br /> ) <br />CABARRUS COUNTY ) <br /> <br /> THIS AGREEMENT, made and entered into this the 16th day of March, <br />1982, by and between the COUNTY OF CABARRUS (hereinafter called "County") <br />and DUKE POWER COMPANY (hereinafter called "Duke"); <br /> <br />WITNESSETH : <br /> <br /> THAT WHEREAS Duke has been requested by County to install two <br />underground primary electric lines and services to Frank Liske Park on <br />Stough Road in or near Concord, North Carolina, said lines to consist of <br /> <br />0.24 miles of underground 1/O ALU. 15KV JACKETED CABLE <br />Single Phase RADIAL FEED TO A RECONSTRUCTED BARN; and <br /> <br />0.38 miles of underground 1/0 ALU. 15KV JACKETED CABLE <br />Three Phase RADIAL FEED TO A NEW BALLPARK; <br /> <br /> <br />
