($33,560) <br />for modifications to the existing Motorola console in <br />Cabarrus County. <br /> <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner ?ayne and <br />unanimously carried, the Board accepted the bids as approved by the <br />Centralina Council of Governments and authorized the signing of the <br />following contract between Cabarrus County and the Centralina Council of <br />Governments for the County to provide matching funds of 25 percent of the <br />total contract. <br /> <br />NORTH CAROLINA <br />MECKLENBURG COUNTY <br /> <br /> CONTRACT FOR <br />EMERGENCY SERVICES EQUIPMENT <br /> <br /> THIS AGREEMENT, made and entered into this 7th day of September, <br />1982, by and between Cabarrus County, hereinafter referred to as the <br />County, and the CENTRALINA COUNCIL OF GOVERNMENTS, hereinafter referred to <br />as the Council; <br /> WITNESSETH: <br /> WHEREAS, Cabarrus County desires to improve their emergency medical <br />services program, and has submitted to the Council a proposal for such <br />improvement; and <br /> WHEREAS, said proposal was included in the EMS Area III Emergency <br />Medical Services System Improvement - 1204(1) application prepared by the <br />Council for submittal to the U.S. Department of Health and Human Services <br />through the N.C. Department of Human Resources; and <br /> WHEREAS, the Council's application, including the County's proposal, <br />has been approved and subsequently funded; <br /> NOW THEREFORE, in consideration of the premises and payment of the <br />funds as hereinafter set forth, both the County and the Council do mutually <br />agree to the following: <br /> <br />GENERAL UNDERSTANDINGS <br />1. The Council agrees to provide or to cause to be provided those <br /> certain items of EMS Communications Equipment set forth in <br /> Exhibit A, attached hereto and incorporated herein by reference. <br />2. The Council agrees to pay 75% of the total purchase price of <br /> those certain items set forth in Exhibit A, provided that under <br /> no circumstances shall the amount paid by the Council exceed <br /> $114,026.63. <br />3. The County agrees to provide toward the total purchase price an <br /> amount equal to at least 25% of the total purchase price of items <br /> set forth in Exhibit A. <br /> Payment of funds by the Council as specified in this agreement <br /> is conditioned upon and subject to the Council's receipt of <br /> funds allocated and appropriated for this purpose from the N.C. <br /> Department of Human Resources. <br /> The County agrees to name Mr. Benny H. Mabrey, Sr. as their <br /> official project director for all matters pertaining to this <br /> agreement. <br /> The County agrees to submit in writing to the Council any request <br /> for changes in the aforesaid equipment or budget therefor, and to <br /> receive the approval of the Council prior to implementing any <br /> such changes. <br /> For those items of equipment to be purchased or negotiated by the <br /> County, the County agrees to abide by the provisions of North <br /> Carolina General Statute 143-129 regarding procurement of the <br /> aforesaid equipment, and any other applicable laws governing the <br /> expenditure of State funds. <br /> Title to the aforesaid equipment, upon delivery and acceptance <br /> thereof, shall be vested in the County, and all warranties shall <br /> similarly become vested to the County. Any agreements for <br /> servicing of said equipment shall be made directly with the <br /> vendor by the County, at the county's sole cost and expense. <br /> <br /> <br />
