S. Brown, Jr., Attorney representing the petitioner, and Mr. Jon R. <br />Finger, petitioner, reviewed the request for the closing of this segment of <br />Coventry Road. No one appeared in opposition to the proposed closing of <br />the segment of Coventry Road. <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board adopted the following Order. <br /> <br />ORDER CLOSING SEGMENT OF COVENTRY ROAD <br /> <br /> The Board of County Commissioners for Cabarrus County, North Carolina, <br />at its regular meeting held in the Commissioners' Room in the Cabarrus <br />County Courthouse on May 16, 1983, at .7:30 o'clock p.m., does make the <br />following findings of fact: <br /> <br /> 1. That a petition has been duly filed with the Board of Commissioners <br />for Cabarrus County requesting that following described segment of Coventry <br />Road be closed: <br /> <br />BEGINNING at an old iron stake, corner of Marshall Cheek, this <br />stake being in the northern edge of Coventry Road at the point <br />where it makes a right-angle turn to the north, and runs thence <br />along the northern edge of the unopened roadway along the line <br />of Marshall Cheek, North 85-56 East 308.8 feet to an iron stake <br />on the western edge of Azalea Avenue; thence along Azalea Avenue <br />and the unopened end of Coventry Road, South 5-12 West 50.17 feet <br />to a stake; thence South 15-31 West 11.1 feet to a stake in the <br />unopened section of Coventry Road; thence along the southern edge <br />of the unopened section of Coventry Road, South 85-56 West 308.8 <br />feet, more or less, to a point; thence across the western end of <br />the unopened segment of Coventry Road, North 0-29 West 60 feet, <br />more or less, to'the point of Beginning. <br /> <br /> 2. That the Board of Commissioners on April 18, 1983, adopted a <br />resolution declaring its intent to close that segment of Coventry Road <br />described above and setting a public hearing to be held on said resolution <br />at 7:30 o'clock p.m. on May 16, 1983, at the Commissioners' Meeting. <br /> <br /> 3. That said hearing was held by the Board of County Commissioners <br />and at the hearing there appeared one of the petitioners, Mr. Jon R. <br />Finger, and his legal counsel, ~. B. S. Brown, Jr., and presented infor- <br />mation to the Board concerning the segment to be closed and filed with <br />the Board an Affidavit concerning said closing. <br /> <br />4. That the following notices were given of the public hearing: <br /> <br /> (a) A notice of the public hearing and a copy of the resolution <br />of intent was duly published in the Kannapolis Daily Independent <br />for four successive weeks immediately prior to the hearing. <br /> <br /> (b) Copies of the notice of hearing were mailed to those <br />property owners as shown on the tax records who have property <br />immediately adjacent to the segment of the road to be closed. <br /> <br /> <br />
