288 <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz and <br />unanimously carried, the Board granted permission for a pyrotechnics display <br />at the Charlotte Motor Speedway during the race on May 29, 1983, and for <br />a pyrotechnics display at the Frank Liske Park beginning at dark on June 4, <br />1983, and lasting about 20-25 minutes. Mr. Gary A. Partlow, pyrotechnic <br />expert of Southern International Fireworks, Inc., will be in charge of <br />the fireworks display at both the Charlotte Motor Speedway and the Frank <br />Liske Park. The proper Certificate of Insurance for each display was filed <br />with Cabarrus County. <br /> UPON MOTION of Commissioner Lentz, seconded by Chairman Nash with <br />Commissioners Lentz, Barnhardt, and Milloway and Chairman Nash voting for <br />and Commissioner Payne voting against, the Board adopted the following <br />Lease Agreement between Cabarrus County and the Board of Light and Water <br />Commissioners of the City of Concord regarding the Sidestown-Shankletown <br />sewer line and including the front footage charge of $3.50 per front foot <br />for future connections to the sewer line. <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br /> THIS LEASE AGREEMENT, made and entered into this 16th day of May, <br />1983, by and between CABARRUS COUNTY, party of the first part (hereinafter <br />referred to as "CABARRUS"), and BOARD OF LIGHT AND WATER COMMISSIONERS <br />OF THE CITY OF CONCORD, party of the second part (hereinafter referred <br />to as "BOARD"); <br /> <br />WITNESS ETH : - <br /> <br /> That whereas, Cabarrus through grants from the State and Federal <br />Government, has constructed a sewer collection system in the area of <br />Cabarrus County off of Central Drive known as Sidestown-Shankletown area, <br />which sewage collection system connects with the interceptor sewer lines <br />presently being operated by the Board; and whereas Cabarrus and the Board <br />have agreed that for the best interest of both parties that the sewer <br />collections system, hereinafter and above referred to, should be opergted <br />and maintained by the Board, and that the Board will accept said system, <br />and said system be leased to the Board by Cabarrus. <br /> <br /> NOW, THEREFORE, in consideration of the premises and the agreements <br />hereinafter made, Cabarrus does hereby let and lease to the Board the <br />perpetual right of way for a sewer line and the sewer line which has been <br />constructed on said right of way in the Sidestown-Shankletown area of <br />Cabarrus County, said rights of way having been granted to Cabarrus. <br /> <br />The terms and conditions of this Lease are as follows: <br /> <br /> 1. The Board hereby agrees to maintain said sewer collection system <br />and to accept sewage from the persons and businesses connected to said <br />sewer collection system for treatment at its treatment facility, and to <br />collect the cost of said treatment from the persons in businesses using <br />said sewage collection system. It is further agreed that the cost of <br />treatment shall be determined from time-to-time by the Board, or its <br />successors, said cost to be not more than the cost charged similar type <br />customers located outside of the corporate limits of the City of Concord, <br />which charge shall be paid by the persons using the system. <br /> <br /> 2. It is understood and agreed that the Board shall provide sewer <br />service to persons who are now connected to the lines upon the terms herein- <br />before set out, and that the Board may accept other customers; provided that <br />such other customers shall be required to pay to Cabarrus a front footage <br />charge of $3.50 dollars per front foot, and the Board, or its successors, <br />would have the right to make its other normal charges pertaining to sewer <br />connections and to retain those charges. <br /> <br /> IN TESTIMONY WHEREOF, the parties have caused this instrument to be <br />duly executed pursuant to authority duly given, the day and year first above <br />written. <br /> <br /> <br />
