289 <br /> <br />ATT EST: <br /> <br />Clerk <br /> <br />ATTEST: <br /> <br />Clerk <br /> <br />CABARRUS COUNTY <br />By: <br /> <br />Chairman, Board of Commission <br /> <br />PARTY OF THE FIRST PART <br /> <br />BOARD OF LIGHT AND WATER <br />COMMISSIONERS OF THE CITY OF CONCORD <br />By: <br /> <br />Chairman <br /> <br />PARTY OF THE SECOND PART <br /> <br /> UPON MOTION of Commissioner Milloway, seconded by Chairman Nash and <br />unanimously carried, the Board appointed Commissioner Archie Barnhardt to <br />the Cabarrus County Board of Social Services for a term of three years <br />expiring June 30, 1986. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz and <br />unanimously carried, the Board approved the following Agreement between <br />Cabarrus County and the Board of Light and Water Commissioners of the City <br />of Concord as corrected. <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br /> THIS AGREEMENT, made and entered into this 16th day of May, 1983, by <br />and between CABARRUS COUNTY, party of the first part (hereinafter referred <br />to as "CABARRUS"), and BOARD OF LIGHT AND WATER COMMISSIONERS OF THE CITY <br />OF CONCORD, party of the second part (hereinafter referred to as "BOARD"); <br /> <br />WITNESS ETH : - <br /> <br /> That whereas, Cabarrus is in the process of building water supply <br />lines outside of the corporate limits of the City of Concord, and whereas <br />it desires to purchase water from the Board and the Board is willing to <br />sell water to the City upon the terms and conditions hereinafter set forth; <br /> <br /> NOW, THEREFORE, in consideration of the premises and the agreements <br />hereinafter made, the parties do agree as follows: <br /> <br /> 1. The Board will sell to Cabarrus water at a rate which is the same <br />as the best rate available for customers of the Board inside the corporate <br />limits of the City of Concord. <br /> <br /> 2. Water would be delivered by the Board to the County at selected <br />points, mutually agreed upon by both parties hereto, and will 'be metered through <br />a master meter connection at each of those points. Cabarrus will install <br />said meters which meters would have to be compatible with the water supply <br />facilities of the Board. <br /> <br /> 3. The Board will provide water at a specific pressure and will provide <br />and guarantee at least one million gallons of water per day to Cabarrus, <br />subject however to the obligation of the Board to provide water to its other <br />customers, both within and without the corporate limits of the City of <br />Concord. <br /> <br /> 4. The Board agrees that it will consider reasonably any request of <br />Cabarrus for additional water supply, if the same becomes necessary for <br />Cabarrus. Cabarrus would discuss and negotiate with the Board for additional <br />waters, it it needs additional waters, prior to procuring those water <br />supplies elsewhere. <br /> <br /> 5. Cabarrus will operate and maintain all facilities in its water <br />system on its side of the master meters hereinbefore referred to, and would <br />bill all of its retail customers. It is contemplated that Cabarrus would <br />bill customers at a rate in excess of Concord's outside retail rate. <br /> <br /> <br />
