289 ATT EST: Clerk ATTEST: Clerk CABARRUS COUNTY By: Chairman, Board of Commission PARTY OF THE FIRST PART BOARD OF LIGHT AND WATER COMMISSIONERS OF THE CITY OF CONCORD By: Chairman PARTY OF THE SECOND PART UPON MOTION of Commissioner Milloway, seconded by Chairman Nash and unanimously carried, the Board appointed Commissioner Archie Barnhardt to the Cabarrus County Board of Social Services for a term of three years expiring June 30, 1986. UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz and unanimously carried, the Board approved the following Agreement between Cabarrus County and the Board of Light and Water Commissioners of the City of Concord as corrected. NORTH CAROLINA CABARRUS COUNTY THIS AGREEMENT, made and entered into this 16th day of May, 1983, by and between CABARRUS COUNTY, party of the first part (hereinafter referred to as "CABARRUS"), and BOARD OF LIGHT AND WATER COMMISSIONERS OF THE CITY OF CONCORD, party of the second part (hereinafter referred to as "BOARD"); WITNESS ETH : - That whereas, Cabarrus is in the process of building water supply lines outside of the corporate limits of the City of Concord, and whereas it desires to purchase water from the Board and the Board is willing to sell water to the City upon the terms and conditions hereinafter set forth; NOW, THEREFORE, in consideration of the premises and the agreements hereinafter made, the parties do agree as follows: 1. The Board will sell to Cabarrus water at a rate which is the same as the best rate available for customers of the Board inside the corporate limits of the City of Concord. 2. Water would be delivered by the Board to the County at selected points, mutually agreed upon by both parties hereto, and will 'be metered through a master meter connection at each of those points. Cabarrus will install said meters which meters would have to be compatible with the water supply facilities of the Board. 3. The Board will provide water at a specific pressure and will provide and guarantee at least one million gallons of water per day to Cabarrus, subject however to the obligation of the Board to provide water to its other customers, both within and without the corporate limits of the City of Concord. 4. The Board agrees that it will consider reasonably any request of Cabarrus for additional water supply, if the same becomes necessary for Cabarrus. Cabarrus would discuss and negotiate with the Board for additional waters, it it needs additional waters, prior to procuring those water supplies elsewhere. 5. Cabarrus will operate and maintain all facilities in its water system on its side of the master meters hereinbefore referred to, and would bill all of its retail customers. It is contemplated that Cabarrus would bill customers at a rate in excess of Concord's outside retail rate.
