338 <br /> <br /> UPON MOTION of Commissioner Barnhardt, seconded by Chairman Nash with <br />Commissioner Barnhardt and Chairman Nash voting for and Commissioner <br />Milloway voting against, the Board approved Petition 83-14 to rezone <br />Map/PIN 5623(13)-04-2777 from RMF-6 to C-3. <br /> <br />(5) <br /> <br />Kannapolis Service Company and Roy D. Mills. Petition 85-15. <br />Township 4. Corner of Winecoff School Road & South Main Street. <br />Map/PIN 5612(20)-82-1228, 82-7185. Wishes to rezone from O-I to C-3. <br />Planning Board approved rezoning request. <br /> <br /> Mr. Fletcher Hartsell, attorney representing the petitioners, spoke <br />in support of the rezoning request. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner <br />Milloway and unanimously carried, the Board approved Petition 83-15 to <br />rezone Map/PIN 5612(20)-82-1228, 82-7185 from 0-I to C-3. <br /> <br />ZONING TEXT AMENDMENTS <br /> <br />(1) <br /> <br />Page 12 Section 3.2-4. Churches and Related Uses. <br /> <br />Permit churches and related uses in the A-I district where at present <br />they are not permitted. Planning Board approved proposed text <br />amendment. <br /> <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner <br />Barnhardt and unanimously carried, the Board approved the zoning text <br />amendment as presented to permit churches and related uses in the A-I <br />district where at present they are not permitted. <br /> <br />(2) Page 92 Section 9 Subsection 9.1 <br /> <br />Add to make the first sentence. <br />The requirements of Section 9 and all subsections hereunder only <br />apply to persons who are making applications for conditional use. <br />Planning Board approved proposed text amendment. <br /> <br /> UPON MOTION of Commissioner Barnhardt, seconded by Chairman Nash and <br />unanimously carried, the Board approved the zoning text amendment as presented <br />to insert the following sentence at the beginning of Section 9 Conditional Uses, <br />Subsection 9.1 Intent. <br /> <br />The requirements of Section 9 and all subsections hereunder only <br />apply to persons who are making applications for conditional use. <br /> <br />(3) Page 114 Section 10.2 <br /> <br />An application for an amendment that has been denied in whole or <br />in part or has been approved for a more restrictive classification <br />than requested shall not again be considered by the Board of <br />County Commissioners. <br /> <br />Amend the previous statement to read: <br /> <br />An application for an amendment that has been denied in whole or <br />in part or has been approved for a more restrictive classification <br />than requested shall not again be processed for consideration by <br />the Board of County Commissioners for a one (1) year period. <br /> <br />Planning Board approved the proposed text amendment. <br /> <br /> UPON MOTION of Commissioner Barnhardt, seconded by Chairman Nash <br />and unanimously carried, the Board approved the zoning text amendment as <br />presented to amend the first sentence of the second paragraph of Section <br />10.2 Amendment Applications to read as follows. <br /> <br />An application for an amendment that has been denied in whole or <br />in part or has been approved for a more restrictive classification <br />than requested shall not again be processed for consideration <br />by the Board of County Commissioners for a one (1) year period. <br /> <br /> <br />
