381 <br /> <br /> 5. Funding for the entire project, including preliminary engineering <br />reports, will be by Cabarrus County; that the County will provide the <br />Town with sufficient funds to pay all costs of the project as they become <br />due and payable on a monthly basis; that all such costs connected with the <br />project, including engineering, accounting, legal, acquisition of rights <br />of way and property and administrative costs are to be requested monthly <br />of the County by the Town by written schedule of such costs. <br /> <br /> 6. The County reserves the right to approve the Town's plans for <br />the interceptor pipeline before acceptance by the Town. The bids received <br />by the Town for the construction of said project will be submitted to the <br />County for its approval prior to acceptance by the Town and no bid will <br />be accepted for the Town until the County has approved the same. The <br />County will consider the bids at its next regular Board meeting provided <br />the bids are submitted to the County Office not later than Thursday <br />prior to the next regular meeting, unless a special meeting of the Board <br />appears necessary. <br /> <br /> 7. The County has committed the sum of $2,300,000.00 to fund the <br />project. In the event of unforeseeable delays, inflationary elements, <br />disasters or other circumstances beyond Town's control, the Town will <br />advise the County as soon as practical of such emergency or other facts <br />leading to the conclusion that additional funding will be necessary to <br />complete the project. The County will have the right to decide the way <br />and manner to resolve the unforeseeable contingencies upon being requested <br />to provide additional funding. In any event the Town will not be responsible <br />for any funding of the project. <br /> <br /> 8. Upon completion of the interceptor pipeline and final inspection <br />the County will be solely responsible for its upkeep, maintenance and <br />operation of the line. <br /> <br /> 9. During the acquisition of the property, rights of way and ease- <br />ments and the construction stages of the project the County will assist <br />and cooperate in any proceedings necessary to acquire property rights, <br />easements and rights of way. <br /> <br /> 10. Throughout the project the County will offer the expertise of <br />its officials in any way needed to expedite the project. The County will <br />timely execute all documents deemed necessary in connection with the <br />success of the project. <br /> <br /> 11. After the interceptor line is operational there may be trans- <br />portation charges payable by the Town to the County for ~se of the line <br />as determined from time to time by the County or its successors. <br /> <br /> 12. The Town will have an independent engineer to serve as resident <br />inspector on the project.
