380 <br /> <br /> Mr. Greg McLain of the audit firm of Arthur Young & Company reported <br />that the 1983 County audit was progressing well and should be ready for <br />presentation to the Board on October 3, 1983. <br /> Commissioner Payne reported that the full extent of a problem concerning <br />a possible fire hazard created by wood paneling in several County schools <br />had not been determined. He stated that the Board would receive a full <br />report from the Superintendent of County Schools of future developments. <br /> Chairman Nash reported that railway passenger service from Charlotte <br />to Raleigh is presently under consideration by the North Carolina Department <br />of Transportation and the National Rail Passenger Corporation (Amtrak). <br />He stated that the service would provide an efficient means of transportation <br />for people from Charlotte to Raleigh and asked the Board's authorization <br />to contact County Commissioners in other counties regarding the adoption <br />of a joint resolution in support of the proposed railway passenger service. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz and <br />unanimously carried, the Board authorized Chairman Nash to contact the <br />Chairman of the Board of Commissioners in other counties concerning a <br />resolution to obtain the train service from Charlotte to Raleigh. <br /> The Board recessed at 11:50 A.M. for lunch at Beverly Hills School <br />with the Cabarrus County Board of Education. The meeting reconvened at 1:05 P.M. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Milloway <br />and unanimously carried, the Board approved the following agreement <br />between Cabarrus County and the Town of Harrisburg. <br /> <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br /> <br />AGREEMENT <br /> <br /> THIS AGREEMENT, entered into this 7th day of September, 1983, <br />by and between the Town of Harrisburg, a municipal corporation, State <br />of North Carolina (the "Town"), party of the first part; and the County <br />of Cabarrus, State of North Carolina (the "County"), party of the second <br />part; <br /> <br />W ITN E S SETH: <br /> <br /> WHEREAS, the parties hereto have agreed to enter into a project to <br />construct an interceptor pipeline to carry the flow of sewage from <br />Harrisburg to the Rocky River Regional Wastewater Treatment Plant. <br /> <br /> WHEREAS, the Town of Harrisburg has agreed to serve as the contcacting <br />agency for the construction of the interceptor pipeline, acquisition of <br />real property, rights of way and easements. <br /> <br /> NOW, THEREFORE, for and in consideration of the premises, the mutual <br />promises, and covenants herein contained, and the mutual benefits flowing <br />to the parties hereunder, the parties hereby agree and contract as follows: <br /> <br /> 1. The Town of Harrisburg will serve as contracting agency for the <br />project and will employ engineers to design the project and prepare plans <br />and specifications for its construction. <br /> <br /> 2. The Town will acquire all property, easements and rights of way <br />and other property interests as may be necessary for the construction and <br />maintenance of the interceptor pipeline and take title to such properties <br />in the name'of Cabarrus County. <br /> <br /> 3. The Town will contract for the construction of the interceptor <br />pipeline project. <br /> <br /> 4. The Town will handle all money for the payment of the costs of <br />constructing the interceptor pipeline and all necessary engineering, <br />legal, accounting, administrative, and other incidental expenditures <br />associated with the construction of the interceptor pipeline and acquisition <br />of all property, easements and rights of way. <br /> <br /> <br />
