That the Board of Commissioners on December 19, 1983, adopted a <br />resolution declaring its intent to close that segment of Barcliff Road <br />described above and setting a public hearing to be held on said resolution <br />at 8:00 o'clock p.m. on January 16, 1984, at the Commissioners' Meeting. <br /> <br /> 3. That said hearing was held by the Board~of County Commissioners <br />and at the hearing there appeared R. !~. Faggart, President of Southern Homes, <br />Inc., who gave information to the Board concerning the segment to be closed <br />and filed with the Board an Affidavit concerning said closing. <br /> <br />4. That the following notices were given of the public hearing: <br /> (a) Caused to be published in the Concord Tribune for four <br />successive weeks before this hearing a copy of the resolution of intent <br />which was adopted by the Cabarrus County Board of Commissioners relative <br />to the closing of the street. The publisher's Affidavit of publication <br />is attached to this Affidavit as Exhibit A. <br /> (b) That petitioners own all property contingent to Barcliff <br />Road. <br /> (c) Caused to be posted at each end of the segment df road to be <br /> closed a notice of closing and of the public'hearing. <br /> (d) Posted a copy of the notice of closing and public hearing <br /> at the Courthouse door in Concord, North Carolina. <br /> <br /> 5. That the petitioners are the only parties who own property immediately <br />adjacent to the segment of the roadway sought to be closed. <br /> <br /> 6. That the segment of roadway sought to be closed has never been <br />opened and has never been used as a public street or roadway and has not <br />been accepted by the North Carolina Department of Transportation as a part <br />of its roadway system. <br /> <br /> 7. That the Board is satisfied that the closing of the easement for <br />the unopened segment of Barcliff Road as described above is not contrary to <br />public interest and that no individual owing property in the vicinity of the <br />roadway or in the subdivision in which it is located would thereby be deprived <br />of reasonable means of ingress and egress to his property. <br /> <br /> THEREFORE, BE IT ORDERED by the Board of County Commissioners for <br />Cabarrus County, North Carolina: <br /> <br /> 1. That the segment of Barcliff Road, Number Nine Township, Cabarrus <br />County, North Carolina, as described above be and the same is hereby closed. <br /> <br /> 2. That a copy of this Order be certified by the Clerk of this <br />Board and be filed in the Office of the Register of Deeds for Cabarrus <br />County, North Carolina. <br /> <br />Entered this the 16th day of January, 1984. <br /> <br />/s/ Frankie F.
