481 <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board moved to table the ordinance proposed <br />to regulate transient dealers for an indefinite period of time. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board adopted the following Agreement between <br />the Town of Harrisburg and Cabarrus County concerning the charges on the <br />sewer line. <br /> <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br /> <br />AGREEMENT <br /> <br /> THIS AGREEMENT, entered into this day of , 1984,. <br />by and between the Town of Harrisburg, a municipal corporation, State <br />of North Carolina (the "Town"), party of the first part; and the County <br />of Cabarrus, State of North Carolina (the "County"), party of the <br />second part; <br /> <br />W I TN E S S ET H: <br /> <br /> WHEREAS, the County of Cabarrus and the Town of Harrisburg have <br />entered into two contracts dated September 7, 1983 and September 22, 1983, <br />regarding the construction, ownership and use of an interceptor pipeline <br />from Harrisburg to the Rocky River Regional Wastewater Treatment Plant. <br /> <br /> WHEREAS, the parties hereto desire to establish a formula to determine <br />the maximum charges payable by Harrisburg for use of the interceptor <br />pipeline; that the formula prepared by the engineering firm of Henningson, <br />Durham & Richardson, Inc., as hereinafter set forth is acceptable by the <br />parties. <br /> <br /> NOW, THEREFORE, for and in consideration of the premises, the mutual <br />promises, and covenants herein contained, and the mutual benefits flowing <br />to the parties hereunder, the parties hereby agree and contract as follows: <br /> <br /> 1. That the maximum charges payable by Harrisburg to the County <br />of Cabarrus for transportation costs for use of the interceptor line <br />shall not exceed an amount determined by the formula as follows: <br /> <br />1. Regional Treatment Charge <br /> <br />RTCH = RTCC x MGH <br /> MGC <br /> <br />o <br /> <br />Where: <br /> RTCH = Harrisburg share of the Regional Treatment Charge <br /> RTCC = Regional Treatment Charge County is charged by Concord <br /> MGH = Monthly total of gallons of wastewater measured at <br /> Harrisburg <br /> MGC = Monthly total of gallons of wastewater measured at the <br /> County point of discharge to the Concord System. <br /> <br />County Operation and Maintenance Cost <br /> <br />COMH = COM x MGH <br /> MGC <br /> <br />Where: <br /> COMH = Harrisburg share of the County's <br /> Operation andMaintenance Cost <br /> <br />COM = County's monthly operations and maintenance costs <br /> <br />MGH = As above <br />MGC = As above <br /> <br />3. Capital Cost Recovery <br /> <br /> <br />
