567 <br /> <br />18-30-16 w. 495.00 feet with the eastern edge of the right-of-way of <br />Rainbow Drive to a new iron stake in the southeastern intersection of <br />the rights-of-way of Rainbow Drive and Pine Street; thence N. 86-25-50 <br />E. 1432.21 feet along and across the southern edge of the pavement of <br />Pine Street to a point in the centerline of Irish Buffalo Creek, said <br />point lying in the southern boundary line of Don Wagstaff; thence S. <br />29-34-23 W. 61 feet, more or less, with the centerline of Irish Buffalo <br />Creek to the point of Beginning. <br /> <br /> B. S. Brown, Jr., representing the Kannapolis Sanitary District, <br />presented the following resolution which was read: <br /> <br />RESOLUTION RELATING TO THE ANNEXATION OF <br />TERRITORY TO KANNAPOLIS SANITARY DISTRICT <br /> <br /> BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR THE COUNTY OF <br />CABARRUS: <br /> <br /> Section 1. That the Board of Commissioners for the County of Cabarrus <br />has determined and does hereby find and declare: <br /> <br /> (a) That on May 2, 1984 a resolution was received from the Sanitary <br />District Board of the Kannapolis Sanitary District relating to the <br />annexation of territory to the Kannapolis Sanitary District. <br /> (b) That the territory described in the petition consists of the <br />properties of Kiser Beaver Real Estate and George L. Kiser, Jr. and <br />Leonard R. Beaver. <br /> (c) That the petition was signed by all property owners within the <br />area requested to be annexed. <br /> (d) That said petition requests that all necessary action required <br />by Article 12 of Chapter 130 of the General Statutes of North Carolina <br />for the extension of the boundaries of the Kannapolis Sanitary District <br />be taken so as to annex the territory described in the petition unto the <br />Kannapolis Sanitary District. <br /> (e) That it is for the best interest of the Kannapolis Sanitary. <br />District and the territory requested to be annexed unto the Kannapolis <br />Sanitary District that said territory be included within the boundaries <br />of the Kannapolis Sanitary District and receive the services of the <br />Sanitary District. <br /> <br /> Section 2. That the Board of Commissioners for the County of Cabarrus <br />does hereby approve the annexation of the territory described in the <br />petition unto the Kannapolis Sanitary District and does hereby recommend <br />to the North Carolina Commission for Health Services that it approve the <br />annexation of the territory unto the Kannapolis Sanitary District. <br /> <br /> Section 3. That the Clerk of the Board of Commissioners for the <br />County of Cabarrus is hereby directed to certify a copy of this resolution <br />to the Director, Division for Health Services, Department of Human Resources, <br />State of North Carolina. <br /> <br /> Thereupon, upon motion of Commissioner Milloway, seconded by Commissioner <br />Nash, the foregoing resolution entitled: "RESOLUTION RELATING TO THE <br />ANNEXATION OF TERRITORY TO KANNAPOLIS SANITARY DISTRICT" was passed by the <br />following vote: <br /> <br />Ayes: <br />Noes: <br /> <br />Chairman Lentz and Commissioners Barnhardt, Milloway, Nash <br />and Payne <br />None <br /> <br /> The boundaries of the territory petitioned by Kiser Beaver Real Estate <br />and George L. Kiser, Jr., and Leonard R. Beaver to be annexed to and <br />included in the Kannapolis Sanitary District are as follows: <br /> <br />BEGINNING at a point in the present boundary line of the Kannapolis <br />Sanitary District at the point where the Kannapolis Sanitary District <br />boundary line intersects the center line of Brantley Road, this <br />beginning point lying 150 feet East of the point where the center line <br /> <br /> <br />
