139 <br /> <br />RESOLUTION <br /> <br /> WHEREAS, the community of Kannapolis became an incorporated city <br />on the llth day of December, 1984; and <br /> <br /> WHEREAS, services to the Cabarrus County portion of Kannapolis, <br />including but not limited to police protection, health services, <br />animal warden services, and planning and zoning services, have been <br />provided by the County of Cabarrus; and <br /> <br /> WHEREAS, the City of Kannapolis will not have revenues with which <br />to pay for services prior to mid-April, 1985, and will most likely be <br />unable to assume responsibility for services heretofore provided by <br />Cabarrus County until at least July 1, 1985; and <br /> <br /> WHEREAS, the City Council of Kannapolis, North Carolina, desires <br />to request the Board of County Commissioners for Cabarrus County, North <br />Carolina, that the county continue to provide services in the Cabarrus <br />County portion of Kannapolis until the city is able to assume <br />responsibility for such services; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Kannapolis, <br />North Carolina: <br /> <br /> 1. That it respectfully requests the Board of County Commissioners <br />of Cabarrus County, North Carolina, that the county continue to provide <br />to the Cabarrus County portion of Kannapolis those services which it has <br />heretofore provided in this area until the city is able to assume the <br />responsibility for such services. <br /> <br /> Mr. Charles D. McGinnis, County Manager, outlined such effects of <br />the incorporation of Kannapolis on the County budget as the transfer of <br />the operation of the Kannapolis Police Department to the City, the need <br />for additional employees in the Sheriff's Department for civil process <br />services, an anticipated contractual agreement between the City and County <br />for planning and zoning services for the Cabarrus County portion of <br />Kannapolis even after the City becomes operational, and the likelihood <br />that the $225,000.00 annual contribution from Cannon Mills Company to <br />Cabarrus County would now be directed to the City of Kannapolis. He also <br />advised the Board that it would be impossible to estimate the amount <br />of tax revenue that will be lost by the County until the City of <br />Kannapolis sets a tax levy which will determine the amount of revenue <br />received by the City from revenue sharing and sales tax proceeds. <br /> A motion was made by Commissioner Barnhardt that the County continue <br />to provide services in Kannapolis as requested through June 30, 1985, but <br />if the City of Kannapolis sets a tax rate before that time, the City will <br />reimburse the County for the sales tax that the County will lose. There was <br />no second to this motion. <br /> An amended motion was made by Commissioner Barnhardt and seconded by <br />Chairman Lentz that the County consent to provide services to the City of <br />Kannapolis as requested provided that the funding to the County from <br />Cannon Mills Company for law enforcement continues through July 1, 1985. <br />No vote was taken on this motion. <br /> A substitute motion was made by Commissioner Payne and seconded by <br />Commissioner Barnhardt that the County continue to service the Kannapolis <br />area through June 30, 1985, as requested provided that the projected income <br />for the County is not reduced by the fact that Kannapolis has become an <br />incorporated city. No vote was taken on this motion. <br /> UPON SUBSTITUTE MOTION of Commissioner Hamby, seconded by Commissioner <br />Payne and unanimously carried, the Board agreed for the County to continue <br />to provide services requested by Kannapolis until June 30, 1985, provided <br />that if the County revenues are reduced significantly by reason of the <br />fact that Kannapolis has become incorporated, the Board will reconsider <br />the provision of services at that time. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board adopted the following budget amendment <br />for the Cabarrus County Recreation Department. <br /> <br /> <br />
