173 <br /> <br />SEWER RIGHT-OF-WAY <br /> <br />STATE OF NORTH CAROLINA,) <br />CABARRUS COUNTY. ) <br /> <br /> Know all men by these presents, that I/we CABARRUS COUNTY of the <br />County of Cabarrus, State of North Carolina, in consideration of the <br />premises and the sum of $1.00 ovc in hand paid by the Board of Light and <br />Water Commissioners, Concord, N.C., the receipt whereof is hereby <br />acknowledged does hereby grant unto the Board of Light and Water <br />Commissioners, its successors and assigns, the right, privilege and <br />easement to go in and upon the following property: <br /> <br />Lying and being in Number 11 Township, Cabarrus County, North <br />Carolina, adjoining the property of Pearl H. Wensil and others <br />and being a strip of land 30 feet in width, the left boundary <br />being 15 feet from and parallel with and the right boundary <br />being 15 feet from and parallel with the following described <br />center lines: <br /> <br />TRACT 1: BEGINNING at a point in the property line of Pearl <br />H. Wensil (said point being S. 85-37-37 East, 67.97 feet from <br />an existing iron pipe corner of Pearl H. Wensil and Cabarrus <br />County Home and runs thence: N. 28-14-46 E., 25.96 feet to <br />a proposed manhole (Sta. 3 + 44.68) thence: N. 7-21-34 West, <br />344.68 feet to an existing manhole on the sewer line running <br />to Cabarrus County Health Department. <br /> <br />TRACT 2: BEGINNING at proposed manhole Sta. 3+44.68 and runs <br />thence: S. 88-21-11 East, 90 feet (+ -) to a point in the <br />right of way line of Palmer Street. <br /> <br />TOGETHER WITH A CONSTRUCTION EASEMENT ten (10) feet in width <br />adjoining the aforesaid right of way lying on the left and right <br />side of said right of way. <br /> <br />See plat prepared by Concord Engineering and Surveying - a copy <br />of which is attached hereto. <br /> <br /> And to construct and maintain in, upon and through said premises in <br />a proper manner with all necessary pipes, a sewer line, togethcr with <br />the right at all times to enter upon said premises for the purpose of~ <br />inspecting said sewer line, and making all necessary repairs and alterations <br />thereon by hauling with necessary conveyances, materials for said purposes; <br />together with the right to cut away and keep clear of said sewer line all <br />trees and other obstructions that may in any way endanger or hinder the <br />proper operation of the same. <br /> <br /> IN WITNESS WHEREOF the said Chairman of the Cabarrus County Board of <br />Commissioners has/have hereunto set their hand(s) and seal(s) on this <br /> 18th day of February , 19 .85. <br /> <br /> CABARRUS COUNTY <br /> <br /> By: /s/ James W.
