312 <br /> <br /> There was no one else to speak regarding the grant application and <br />the public hearing was closed. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Payne and <br />unanimously carried, the Board set a second public hearing at 7:45 P.M. on <br />October 21, 1985, regarding the Economic Development Grant and authorized <br />the Planning Department to continue the application process for this grant. <br /> The bids received on September 27, 1985, for the annual Central Office <br />Supplies contract were as follows. <br /> <br />VENDORS CERT. CHECK TOTAL BID <br /> <br />Carolina Ribbon <br /> <br />Forms & Supply, Inc. <br />Sunbelt Office & Data Suppliers, Inc. <br /> <br />$795.40 $15,238.05 <br /> $14,232.05 (alt.) <br />$717.12 $14,342.41 <br />$662.15 $13,243.01 <br /> <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board awarded the 1985-86 contract for office <br />supplies to the low bidder, Sunbelt Office & Data Suppliers, Inc., in the <br />amount of $13,243.01. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board approved the following Lease Agreement <br />between Cabarrus County and The Cabarrus County Agricultural Fair, Inc. <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />LEASE AGREEMENT <br /> <br /> THIS LEASE AGREEMENT, made and executed this 7th day of October, <br />1985, by and between CABARRUS COUNTY, a political subdivision of the <br />State of North Carolina, (hereinafter "Lessor"), and THE CABARRUS <br />COUNTY AGRICULTURAL FAIR, INC., a North Carolina Corporation, <br />(hereinafter "Lessee"); <br /> <br /> W I T N E S S E T H -- that: <br /> <br /> For and in consideration of the mutual covenants and agreements <br />hereinafter set forth, Lessor leases to Lessee and Lessee takes and <br />leases from Lessor all that real property lying within the "fence" on <br />the 14.20 acre tract described and identified in "Exhibit A" attached <br />hereto and incorporated herein by reference (hereinafter sometimes <br />referred to as the "Demised Premises"); <br /> <br /> Lessee shall have and hold the Demised Premises subject to the <br />following covenants and conditions: <br /> <br /> 1. Ter__~m. The term of this Lease shall commence on September 1, <br />1986, and shall expire on September 23, 1986. <br /> <br /> 2. Rent/Consideration. As rental for the Demised Premises, <br />Lessee agrees as follows: <br /> <br /> (a) Lessee shall mow the Demised Premises, together with <br />Lessee's 11.98 acre tract adjacent thereto, identified on <br />"Exhibit A", at least once per month during the period May - <br />October, 1986. <br /> <br /> (b) Lessee shall keep the Demised Premises clean and <br />in a good state of repair from the date of execution hereof <br />through September 30, 1986, and shall be permitted entry <br />thereon for such purpose during all of said period. <br /> <br /> 3. Use of Demised Premises. The Demised Premises are leased <br />exclusively for use as an.agricultural fair and associated amusement <br />activities. Lessee shall comply with existing zoning, health, and <br />other police regulations and shall neither conduct nor permit to be <br />conducted any nuisance upon the Demised Premises. <br /> <br /> 4. Indemnification and Insurance. Lessee agrees to indemnify <br />and save harmless Lessor of and from any and all claims or liability <br />to persons or property caused or resulting in any manner by reason of <br /> <br /> <br />
