313 <br /> <br />Lessee's occupation or use of the Demised Premises. Lessee further <br />consents and agrees to maintain liability insurance for injury or <br />damage to any person while on the Demised Premises during the term of <br />at least $1,000,000,00 for injury or damage to one person and <br />$1,000,000.00 for injury or damage to two or more persons. <br /> <br /> 5. Termination. Upon termination of this Lease, Lessee consents <br />and agrees to return Demised Premises to Lessor in as good condition <br />as the same now is, ordinary wear and tear excepted. <br /> <br /> 6. Default. In the event of breach or default by Lessee in <br />performance of any covenant or condition herein contained, such default <br />or breach having continued for ten (10) days after written notice to <br />Lessee by Lessor, then, in such event, at the option of Lessor, Lessor <br />shall have the right to re-enter the Demised Premises or any part <br />thereof and thereupon this Lease shall terminate. <br /> <br /> 7. Notices. Any notice required by the terms of this Lease shall <br />be mailed to Lessor, c/o Charles McGinnis, County Manager, Cabarrus <br />County Courthouse, Concord, North Carolina 28025, and to Lessee, c/o <br />Clyde L. Propst, Jr., General Manager, P. O. Pro~st~ Jr. <br /> <br /> The Board reviewed the effects of the Fair Labor Standards Act on <br />County employees and the necessary revisions to the County Personnel <br />Ordinance for compliance with the Fair Labor Standards Act. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne and <br />unanimously carried, the Board adopted the following amendments to the <br />Cabarrus County Personnel Ordinance as recommended by the County Manager. <br /> <br />(1) <br /> <br />Amend Article III. Section 9, to read as follows. <br /> <br />ARTICLE III. THE PAY PLAN <br />Section 9. Overtime <br /> Overtime work shall be that work performed by an employee <br />which either exceeds the number of hours constituting the <br />established work week for the employee's position or which is <br />accomplished on an unscheduled work day, other than court time. <br />Overtime opportunities will be distributed as equally as <br />practicable among employees in the same job class, department <br />and shift regardless of age, sex, race, color, creed, religion, <br />national origin, political affiliation, or physical handicap. <br /> <br /> Employees required to work overtime may be compensated <br />with time off on a time and one half basis or paid for such <br />time at a rate of time and one half the regular rate of pay <br />for overtime hours worked provided that: <br /> <br />(a) the work is of an unusual, unscheduled or emergency <br /> nature and is directed by the department head or <br /> the authorized representative of the department <br /> head; <br />(b) the position does not involve administrative, <br /> professional or executive work excluded from these <br /> overtime provisions by the county manager; <br />(c) time off shall be granted whenever feasible and <br /> taken within the defined workweek. <br /> <br /> <br />
