364 The substitute motion by Commissioner Payne to adjust the Board of Elections budget in the amount of $500.00 for postage failed for lack of second. The motion by Commissioner Hamby and seconded by Chairman Lentz to approve the requested Elections budget amendment in the amount of $880.80 for postage and to send Mr. Kenneth K. Kiser written information on the budgeting and personnel policies of Cabarrus County failed with Commissioner Hamby and Chairman Lentz voting for and Commissioners Payne, Barnhardt, and Upright voting against. The Board of Commissioners indicated that any need for postage during the remainder of this fiscal year could and would have to be accommodated through a transfer of money from some other line item in the Board of Elections budget to cover this additional cost. Mr. Kenneth K. Kiser also presented a request for a budget amendment to cover the cost of the installation of a telephone extension in the preparation room at the Board of Elections on November 19, 1985. He explained that employees working in the preparation room were unable to hear the telephone in the front office and that the extension would enable the office to better serve the people of Cabarrus County. Mr. Charles D. McGinnis, County Manager, advised the Board that as a result of a telephone survey conducted by The Concord Telephone Company four years ago it was policy that all telephones installed in County offices have to be approved by him prior to installation. He stated The Concord Telephone Company had installed the telephone at the Board of Elections without proper authorization and that instructions had been g{ven for its removal. The Board referred the matter regarding the telephone extension at the Board of Elections to the County Manager. During discussion of the items relating to the Board of Elections, members of the Board of Commissioners expressed strong concern regarding the operation of that office and the recent problems regarding advertising procedures, budgetary matters, and the failure to follow established County policies. At 10:00 A.M., Chairman Lentz stated that this was the day and hour scheduled for a public hearing regarding the petition for the closing of Tulake Drive and asked if anyone were present who wished to speak for or against this road closing. Mr. Thomas M. Brooke, attorney representing the petitioners, spoke in support of the closing of Tulake Drive. No one appeared in opposition to the road closing. ~ UPON MOTION of Commissioner Upright, seconded by Commissioner Payne and unanimously carried, the Board adopted the following Order Closing Tulake Drive. NORTH CAROLINA ) ) CABARRUS COUNTY) ORDER CLOSING TULAKE DRIVE IN FINGERLAKE SUBDIVISION~ NO. 2 TOWNSHIP, CABARRUS COUNTY BE IT HEREBY RESOLVED that a Petition was filed at the December 2, 1985 meeting of the Cabarrus County Commission requesting the closing of public road or easement, pursuant to N.C.G.S. 153A-241; and WHEREAS, the Petitioners are all of the adjoining landowners to Tulake Drive or road dedicated by virtue of plat and map of the Fingerlake Subdivision, No. 2 Township, Cabarrus County, North Carolina, according to the office of the Register of Deeds, Cabarrus County, in plat book 19, page 23; and' WHEREAS, a resolution was adopted declaring the intent of the Cabarrus County Commission to close said public road at the December 2, 1985 meeting, and thereafter notice of said resolution was published once a week for four successive weeks notifying the public of the hearing to be held at the January 6, 1986 meeting; and WHEREAS, notice was prominently posted at least two places along the road; and WHEREAS, the meeting was held at 10:00 a.m. on the 6th day of January, 1986 in the Cabarrus County Commissioners' Room at the Cabarrus County Courthouse; and
