384 <br /> <br /> Upon motion of Commissioner Upright and seconded by Commissioner <br />Barnhardt, the above resolution was introduced for passage. The following <br />number voted in the affirmative: 5 (unanimous) <br />The following number voted in the negative: 0 <br /> <br />The Agreement was as follows: <br /> <br />NORTH CAROLINA LOCAL GOVERNMENTAL EMPLOYEES' RETIREMENT SYSTEM <br /> RALEIGH, NORTH CAROLINA 27611 <br /> <br /> AGREEMENT TO PROVIDE CERTAIN BENEFITS AS <br />SET FORTH IN CHAPTER 1310 OF THE SESSION LAWS OF <br /> 1973 (2ND SESSION, 1974) <br /> <br /> In accordance with the provisions of Chapter 1310 of the Session <br />Laws of 1973 (2nd Session, 1974) setting forth the conditions under which <br />the rights to certain benefits might be made available to members of the <br />North Carolina Local Governmental Employees' Retirement System, this <br />Agreement is hereby entered into between the Cabarrus County Board of <br />Commissioners and the Director of said Retirement System. <br /> <br /> In consideration of an increase of .17% in the employer's contribution <br />rate effective as of April 1, 1986, the North Carolina Local Governmental <br />Employees' Retirement System hereby agrees to extend the privileges and <br />rights of said benefits described in Chapter 1310 of the Session Laws of <br />1973 (2nd Session, 1974) to the employees of the County of Cabarrus who <br />are members of said System on and after the above effective date. This <br />Agreement shall continue in effect from year to year with the understanding <br />that the rate payable for said benefits may be modified as the System's <br />Actuary may periodically determine. <br /> <br /> Approval of the above increase in rate was authorized by Cabarrus <br />County Board of Commissioners at its meeting on February 3, 1986 and <br />is recorded in the minutes of the said Board. <br /> <br />CERTIFICATION: <br /> CHAIRMAN MUST SIGN BY EACH BENEFIT DESIRED <br /> <br />(x) /s/ James W. CREDIT FOR OUT-OF-STATE SERVICE <br /> <br />(Director, Retirement System) <br /> <br />(date) <br /> <br /> UPON MOTION of Commissioner Upright, seconded by Chairman Lentz <br />and unanimously carried, the Board by resolution approved the request <br />from Mr. Robert Melton, General Manager of Vision Cable of Metrolina, <br />to provide cable service to the Steeplechase and Cabarrus Woods neighbor- <br />hoods from the Mecklenburg County cablevision system, Vision Cable of <br />North Carolina. It was understood by the Board that Cabarrus County will <br />continue to receive the regular franchise tax payment of three percent <br />of gross receips for the homes in those communities. <br /> Commissioner Payne expressed concern regarding the density requirements <br />for cablevision service and the unavailability of service to a number of <br />Cabarrus County residents. Chairman Lentz requested the County Manager <br />to contact Mr. Robert Melton Of Vision Cable of Metrolina regarding the <br />firm's tentative five-year plan for providing cable service in the county <br />and the possibility of reducing the density requirements. <br /> The Board reviewed the request from Mr. Richard B. Self, Columbus <br />County Administrator, for the endorsement of a resolution by the Columbus <br />County Board of Commissioners in opposition to Regulation 10 NCAC 10G .0503 <br />(2)(d)(i), as amended January 1, 1985. According to Mr. Self's letter, <br />the regulation imposes unreasonable restrictions on the operation of landfills <br />and imposes a financial burden on counties. Mr. Charles D.
