<br />Petition 86-35. Walter P. Welch, off Highway 24/27, township 10,
<br />Map/PIN 5555-40-8829, 51-1671. Wishes to rezone from A-2 to I-1 or
<br />I-i(PDO-I). Planning Board voted unanimously to recommend denial.
<br />
<br /> Mr. Samuel F. Davis, Jr., attorney, asked that the rezoning petition be
<br />referred back to the Planning Board for an alternate zoning that would be
<br />more agreeable to the neighbors in the area and still permit Pepsi Cola
<br />Company to build a distribution center on the property.
<br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne and
<br />unanimously carried, the Board referred Petition 86-35 back to the Planning
<br />Board giving the petitioners the opportunity to amend their petition in any
<br />way they see fit.

<br />Petition 86-36. Ferrell James, off Roberta Road, township 2, Map/PIN
<br />5519-20-3353, (17)-20-5230 and Others. Wishes to rezone from A-I to
<br />R-9. Planning Board voted 3 to 1 to recommend approval.
<br />
<br /> Mr. Thomas M. Grady, attorney, representing the petitioner, reviewed
<br />plans for the development of a residential community on the property. He
<br />requested that the original petition for the rezoning of 20 acres be amended
<br />to 14 acres with the 6± acres shown on a survey by Zackie L. Moore and dated
<br />December 15, 1986, withdrawn from the petition.
<br /> There was no one present to speak against the rezoning request.
<br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Melvin with
<br />Commissioners Moss, Melvin, and Hamby and Chairman Lentz voting for and
<br />Commissioner Payne voting against, the Board approved Petition 86-36 by
<br />Ferrell James to rezone property off Roberta Road, Map/PIN 5519-20-3353,
<br />(17)-20-5230 and Others, from A-I to R-9 excepting the 6± acres identified on
<br />the survey by Zackie L. Moore dated December 15, 1986, and filed with the
<br />Cabarrus County Planning Department.

<br />SUBDIVISION ORDINANCE
<br />
<br /> At 7:30 P.M., Chairman Lentz opened the public hearing for the revised
<br />Subdivision Ordinance for Cabarrus County.
<br /> Mr. Thomas B. Robinson, Planning Director, reviewed in general the
<br />proposed changes to the Subdivision Ordinance. These changes included
<br />provisions relating to minor subdivisions, minor splits, roadways, water and
<br />sewer service, the point at which lots can be sold, review standards, phased
<br />subdivisions, flood damage prevention, and the performance bond
<br />requirement.
<br /> Mr. Ray Flowers of Harrisburg asked that the Board take time to study
<br />the revised Subdivision Ordinance.
<br /> Mr. Miles Little questioned the Planning Director regarding the differ-
<br />ences between a major and minor subdivision.
<br /> Mr. F. A. Rankin, Jr., stated the need for more study of the revised
<br />Subdivision Ordinance before it is adopted.
<br /> Mr. John Coble asked that the Board not vote on the revised Subdivision
<br />Ordinance at this time. He expressed concern regarding his right to give his
<br />children a portion of his property if he so desired.
<br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby with
<br />Commissioners Hamby and Payne and Chairman Lentz voting for and Commissioners
<br />Moss and Melvin voting against, the Board adopted on first reading the
<br />"Revised" Subdivision Regulations for Cabarrus County with Sections 5.5 and
<br />5.7 completed as follows:

<br />SECTION 5.5 RE-ENACTMENT AND REPEAL OF EXISTING SUBDIVISION ORDINANCE
<br />This provision in part carried forward by re-enactment some of the
<br />provisions of the subdivision ordinance of the County of Cabarrus
<br />adopted on October 5~ 1978~ and effective November 1, 1978.
<br />
<br />SECTION 5.7 EFFECTIVE DATE
<br />This ordinance shall take effect and be in force from and after:
<br />January it 1987.
<br />
<br /> The Board scheduled the second reading of the revised Subdivision
<br />Ordinance for the meeting on January 5, 1987.
<br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Payne and
<br />unanimously carried, the Board amended the effective date provision of the
<br />previous motion from January 1, 1987, to January 5, 1987, as the second
<br />reading of the "Revised" Subdivision Regulations for Cabarrus County will be
<br />held on that date.
