According to Mr. Farris, Camp Dresser and McKee as design <br />engineers had assumed primary responsibility for the failure and paid the <br />county $7,000.00 of the total expenses. The Board took no action on the <br />proposal from Camp Dresser & McKee and instructed the County Attorney to <br />pursue the necessary legal action to recover the remaining $3,033.28 from Law <br />Engineering Company. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby and <br />unanimously carried, the Board approved the following sewer construction <br />contract between Cabarrus County and Rocky River Plantation Joint Venture. <br /> <br />SEWER CONSTRUCTION CONTRACT <br />CONSTRUCTION BY APPLICANT <br /> <br />STATE OF NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br /> Planters Row <br />Rocky River Plantation Joint Venture <br /> <br />APPLICANT <br /> <br /> THIS CONTRACT, made and entered into this the 21st day of November, <br />1988, between Rocky River Plantation Joint Venture, whose address is <br />P. O. Box 2325, Irmo, S.C. 29063~ Cabarrus County, a municipal corporation of <br />said County and State, hereinafter referred to as the "County": <br /> <br />WITNESSETH <br /> <br /> THAT WHEREAS, the Applicant desires to construct sanitary sewer lines to <br />serve certain properties located in Cabarrus County, and such sanitary sewer <br />lines to be constructed at the Applicant's own proper cost and expense; and, <br /> <br /> WHEREAS, the Applicant has requested permission from the County to <br />connect these certain sanitary sewer lines to the County's sanitary sewerage <br />system, said sanitary sewer lines and location of connection to the County's <br />system being more particularly described as follows: <br /> <br />4,968'± of 8" sanitary sewer to serve Planter's Row at Rocky River <br />Plantation and a pump station with 1,018'± of 2 1/1" force main to <br />connect to the pump station in Rocky River Plantation, Phase I. <br /> <br />These sewers and pump station serve Tom Savage Drive, Quay Farm Court, <br />Lethe Lane and Indian Summer Trail. <br /> <br /> NOW, THEREFORE, in consideration of the premises contained herein, the <br />parties hereby agree as follows: <br /> <br />The Applicant is hereby granted permission to connect only those certain <br />sanitary sewer lines as hereinbefore described, at the certain location <br />or locations as previously described herein. The permission so granted <br />shall not be construed as granting permission for any additions or <br />extensions desired to be constructed by the Applicant or others; such <br />additions or extensions shall require a separate and new agreement <br />between the County and the parties desiring to make such additions or <br />extensions. <br /> <br />All construction pertaining to sanitary sewerage shall be performed by a <br />licensed Utility Contractor. The Applicant agrees to furnish the <br />Cabarrus County Utility Department with the name and license number as <br />listed with the North Carolina Licensing Board, of the Contractor who <br />has been retained to construct the before-described sewerage system. <br /> <br />The Applicant agrees to construct the sanitary sewer lines, including <br />any appurtenant structures and equipment, according to the Plans and <br />Profiles as approved by the County Utility Department and in strict <br />accordance with the current specifications and design criteria of the <br />Cabarrus County Utility Department. The applicant also agrees to <br />furnish prior written notice to the County Utility Department as to the <br />exact date construction will begin, and further agrees to furnish the <br /> <br /> <br />
