<br />to speak regarding the road name changes, and the public hearing was closed.
<br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Simmons and
<br />unanimously carried, the Board approved the following road name changes.

<br /> Unnamed Road to Pinebrook Trail (Petition 88-89-01)
<br />St. Paul Church Road to Wagoner Road (Petition 88-89-02)

<br /> Chairman Lentz opened the public hearing on the proposed closing of a
<br />portion of Nantucket Court and asked if anyone were present who wished to speak
<br />for or against the road closing. No one spoke regarding the proposed road
<br />closing, and the public hearing was closed.
<br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Moss and
<br />unanimously carried, the Board adopted the following Order Closing Easement
<br />Dedicated for Public Road.

<br />ORDER CLOSING EASEMENT DEDICATED
<br /> FOR PUBLIC ROAD
<br />
<br /> WHEREAS, at its meeting of April 10, 1989, the Board of Commissioners of
<br />Cabarrus County (the "Board") acknowledged a Petition to adopt a Resolution and
<br />Order closing the approximately 1025-foot-long Nantucket Court located in No.
<br />2 Township, Concord, Cabarrus County, North Carolina, as more particularly
<br />described in Map Book 18, Page 64, of the Cabarrus County Registry, a copy of
<br />which is reproduced as Exhibit A attached hereto (the "Road"), such request being
<br />pursuant to North Carolina General Statute 153A-241; and
<br />
<br /> WHEREAS, the map dedicating Nantucket Court was recorded in the Office of
<br />the Register of Deeds of Cabarrus County on August 15, 1980, but Nantucket Court
<br />has never been placed under the control or supervision of the North Carolina
<br />Department of Transportation; and
<br />
<br /> WHEREAS, at its meeting of April 10, 1989, the Board adopted a Resolution
<br />declaring its intent to close the Road; and
<br />
<br /> WHEREAS, notice of said Resolution was published once a week for four (4)
<br />successive weeks in the Concord Tribune, Concord, North Carolina, notifying the
<br />public of a hearing to be held before the Board on May 15, 1989, at 7:30 p.m.,
<br />or as soon thereafter as persons might be heard; and
<br />
<br />WHEREAS, the Petitioner is the sole property owner abutting the Road; and
<br />
<br /> WHEREAS, such notice was prominently posted on at least two (2) places
<br />along the Road; and
<br />
<br /> WHEREAS, at its regular meeting in the Commissioner's Room of the Cabarrus
<br />County Courthouse at 7:30 p.m. on May 15, 1989, the Board considered such
<br />Resolution; and
<br />
<br /> WHEREAS, at the meeting and hearing on May 15, 1989, the Board considered
<br />all comments before it and determined that the closing of the Road is not
<br />contrary to the public interest, that no individual owning property in the
<br />vicinity of the Road would be deprived of any means of ingress and egress, nor
<br />would an individual owning property in the vicinity of the Road be aggrieved by
<br />the closing of same.
<br />
<br /> BE IT, THEREFORE, ORDERED that Nantucket Court, as hereinbefore described,
<br />be and the same is hereby closed to the public and, pursuant to North Carolina
<br />General Statute 153A-241, the title of the petitioner, the sole abutting
<br />landowner, for the width of its abutting land, hereafter extends to the
<br />centerline of Nantucket Court hereby closed.
