201 <br /> <br /> 2. The City of Concord agrees to furnish and provide <br />continuing fire protection service to all property lying within its <br />boundaries and to provide mutual aid to other Fire Departments in <br />Cabarrus County as provided in N.C.G.S. 69-40. <br /> 3. The City of Concord agrees to operate within the <br />guidelines set forth in the Cabarrus County Fire Protection <br />Resolution, attached to this contract. <br /> 4. This contract may be terminated by either party at the <br />end of the fiscal year by giving 90 days written notice of its <br />intent to so terminate to the other party. <br /> In witness whereof the City of Concord has caused these <br />presents to be signed by its Mayor and attested to by its Clerk, and <br />the County of Cabarrus has caused these presents to be signed by its <br />Chairman and attested by the Clerk of its Board of Commissioners. <br /> This the day of , 1989. <br /> <br />CITY OF CONCORD <br /> <br />Mayor <br /> <br />Attest: <br /> <br />Clerk <br /> <br />COUNTY OF CABARRUS <br /> <br />Chairman <br /> <br />Attest: <br /> <br />Clerk <br /> <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Simmons and <br />unanimously carried, the Board approved the following Contract to Provide Tax <br />District Fire Service between Cabarrus County and the City of Kannapolis for <br />Fiscal Year 1989-1990 and authorized Chairman Lentz to execute the contract on <br />behalf of Cabarrus County. <br /> <br />CONTRACT TO PROVIDE TAX DISTRICT FIRE SERVICE <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br /> THIS CONTRACT, made and entered into effective the 1st day of <br />July, 1989, by and between the City of Kannapolis, a municipal <br />corporation, and the County of Cabarrus; <br /> WITNESSETH: <br /> That for and in consideration of the mutual covenants <br />hereinafter contained, and pursuant to authority granted by G.S. 69- <br />25.5, G.S. 69-25.6, and G.S. 153A-233, the City of Kannapolis and <br />the County of Cabarrus do hereby covenant and agree as follows: <br /> 1. The County of Cabarrus agrees to annually provide a <br />supplement in the sum of $250.00 per month to the City of <br />Kannapolis. This sum shall be payable as specified in the Cabarrus <br />County Fire Protection Resolution. <br /> 2. The City of Kannapolis agrees to furnish and provide <br />continuing fire protection service to all property lying within its <br />boundaries and to provide mutual aid to other Fire Departments in <br />Cabarrus County as provided in N.C.G.S. 69-40. <br /> 3.
