Stat. §160A -279 permits the sale or conveyance of properties to entities carrying out a public purpose; and WHEREAS, the County acquired the buildings and land constituting the Property from Cabarrus County Schools in 2003, and remodeled it for use by Rowan Cabarrus Community College in 2004 -2005 including a lease agreement for that purpose; and WHEREAS, the Cabarrus County, Rowan Cabarrus Community College and Cabarrus County Schools have approved a Memorandum of Understanding for a campus of the Early College to be located on the Property; and WHEREAS, the Board of Commissioners previously agreed by consensus that documents should be prepared to transfer ownership of the Property to Rowan Cabarrus Community College; THEREFORE, THE CABARRUS COUNTY BOARD OF COMMISSIONERS RESOLVES THAT; 1. The Board hereby authorizes the transfer of the Property described above to Rowan Cabarrus Community College through the procedures outlined in N.C. Gen. Stat. §160A -267. 2. The County Clerk shall cause a notice of the proposed conveyance to be published. The notice shall describe the Property and the terms of conveyance. 3. The terms of transfer are that: a. The County Manager and County Attorney shall complete the final terms and conditions for the Property conveyance. b. The deed of conveyance shall include covenants that restrict the use of the Property for a public purpose as outlined in N.C. Gen. Stat. §160A -279 and that all existing agreements, except as noted in 3c below, between Cabarrus County, Rowan Cabarrus Community College and Cabarrus County Schools shall remain in effect. c. The lease agreement effective July 1, 2004 between Cabarrus County and Rowan Cabarrus Community College shall be terminated effective upon recording of the deed of conveyance. Smit, Clerk to the Board (F -3) EMS - Funding Request to Complete the Purchase of Body Armor for Staff EMS received $50,000.00 in grant funds to purchase body armor for their staff in FY16. The total cost of the project was estimated at $75,000.00 but the remaining $25,000.00 was inadvertently left out of the budget request. Funding is requested in the amount of $25,000.00 to complete the purchase of body armor from unallocated contingency. The school system is requesting the reapprcpriation of funds to FY17.
