Stat. §160A -279 permits the sale or conveyance of <br />properties to entities carrying out a public purpose; and <br />WHEREAS, the County acquired the buildings and land constituting the <br />Property from Cabarrus County Schools in 2003, and remodeled it for use by Rowan <br />Cabarrus Community College in 2004 -2005 including a lease agreement for that <br />purpose; and <br />WHEREAS, the Cabarrus County, Rowan Cabarrus Community College and <br />Cabarrus County Schools have approved a Memorandum of Understanding for a campus <br />of the Early College to be located on the Property; and <br />WHEREAS, the Board of Commissioners previously agreed by consensus that <br />documents should be prepared to transfer ownership of the Property to Rowan <br />Cabarrus Community College; <br />THEREFORE, THE CABARRUS COUNTY BOARD OF COMMISSIONERS RESOLVES THAT; <br />1. The Board hereby authorizes the transfer of the Property described <br />above to Rowan Cabarrus Community College through the procedures <br />outlined in N.C. Gen. Stat. §160A -267. <br />2. The County Clerk shall cause a notice of the proposed conveyance to be <br />published. The notice shall describe the Property and the terms of <br />conveyance. <br />3. The terms of transfer are that: <br />a. The County Manager and County Attorney shall complete the final <br />terms and conditions for the Property conveyance. <br />b. The deed of conveyance shall include covenants that restrict the <br />use of the Property for a public purpose as outlined in N.C. Gen. <br />Stat. §160A -279 and that all existing agreements, except as noted <br />in 3c below, between Cabarrus County, Rowan Cabarrus Community <br />College and Cabarrus County Schools shall remain in effect. <br />c. The lease agreement effective July 1, 2004 between Cabarrus County <br />and Rowan Cabarrus Community College shall be terminated effective <br />upon recording of the deed of conveyance. <br />Adopted this the 15 day of August, 2016. <br />/s/ Stephen M. The total cost of the project was estimated at $75,000.00 but <br />the remaining $25,000.00 was inadvertently left out of the budget request. <br />Funding is requested in the amount of $25,000.00 to complete the purchase of <br />body armor from unallocated contingency. <br />UPON MOTION of Vice Chairman Honeycutt, seconded by Commissioner Shue and <br />unanimously carried, the Board adopted the following budget amendment. <br />Date: 8/15/2016 Amount:$25,000 <br />Dept. The school system is requesting the reapprcpriation <br />of funds to FY17. <br />
