April 21, 2014 (Regular Meeting) <br />Page 1992 <br />WHEREAS, the Cabarrus County Sheriff's office, other local law <br />enforcement officers and other affected agencies participate jointly in <br />execution of a plan for transportation of respondents in involuntary <br />commitment proceedings; and <br />WHEREAS, pursuant to N.C. Gen. Stat. §1220- 251(g), the Cabarrus County <br />Sheriff's Office, local law enforcement and other affected agencies are to <br />provide adequate training in the transportation and restraint of mental <br />health patients to private agency personnel designated to provide <br />transportation for these respondents; and <br />WHEREAS, the Charlotte Mecklenburg Hospital Authority ( "CMHA ") operates <br />hospitals, including emergency departments, within Cabarrus County and <br />surrounding counties; and <br />WHEREAS, CMHA receives mental health patients who are respondents in <br />commitment proceedings pursuant to Article 5 of Chapter 122C of the North <br />Carolina General Statutes and who require transportation services from time <br />to time; and <br />WHEREAS, CMHA has entered into a contract with G4S Secured Solutions <br />(USA) , Inc. ( "G4S ") , a private agency, to provide all or part of the <br />involuntary commitment transportation services between CMHA facilities, and <br />WHEREAS, such an arrangement will assist the County and its Sheriff's <br />Office in fulfilling their obligations under Article 5 of Chapter 122C of the <br />North Carolina General Statutes; <br />NOW, THEREFORE, BE IT RESOLVED, that as permitted by N.C. Gen. Stat. <br />§122C- 251(8), this plan for transportation of involuntary commitment <br />respondents between CMHA facilities by G4S is hereby adopted. Such plan <br />shall include a memorandum of understanding between the County and CMHA for <br />provision of these services at no charge to the County, as well as a contract <br />between CMHA and G4S. That contract shall provide for full compliance with <br />N.C. Gen. Stat. §122C -251, for insurance coverage in amounts acceptable to <br />CMHA and the County and for indemnification of the County and the Sheriff's <br />Office. Neither the adoption of the plan nor the designation of G4S as the <br />private agency provider is, or shall be construed as, creating any agency or <br />other relationship between the County, the Sheriff's Office and G4S. <br />Adopted this 21" day of April, 2014. <br />/s/ Elizabeth F. Pleasant <br />Communications Tower <br />Cellco Tower (d /b /a Verizon Wireless) has requested to lease space on <br />the county -owned Mt. Pleasant Communications Tower, including the use of an <br />equipment building. The lease proposal is for two five -year terms with an <br />annual rental of $24,000.00. That amount will increase by ten percent in the <br />second five -year term. In addition, there will be a one -time payment of <br />$9,600.00 for the use of the equipment building for each five -year period. <br />The County Attorney is currently working with Cellco on the final lease <br />terms. <br />A Public Notice was posted on the County's website <br />( www.cabarruscounty.us ) on April 9, 2014 in accordance with Article 2, <br />Administration, Section 2.1 (Use of Electronic Means to Provide Public <br />Notices) of the Cabarrus County Code of Ordinances. <br />UPON MOTION of Commissioner Oesterreich, seconded by Vice Chairman <br />Burrage and unanimously carried, the Board approved lease terms, authorized <br />the County Manager and County Attorney to negotiate the lease and to execute <br />the contract. <br />Resolution No. 2019 -07 <br />
