April 21, 2014 (Regular Meeting) Page 1993 <br />RESOLUTION APPROVING LEASING PROPERTY <br />WHEREAS, Cabarrus County owns a communications tower in Mt. Pleasant, <br />North Carolina with co- location space available for wireless communications <br />providers; and <br />WHEREAS, the Board of Commissioners finds that such co- location space <br />is surplus to the County's needs; and <br />WHEREAS, the County and Cellco Partnership dba Verizon Wireless have <br />agreed upon a lease under which Cellco will lease space on the County <br />communications tower for a term of up to ten (10) years; and <br />WHEREAS, in consideration of leasing such space, Cellco has agreed to <br />pay annual rent of $24,000.00 with a 10% annual rent increase after five (5) <br />years; and <br />WHEREAS, Cellco shall also pay $9,600.00 at the beginning of each five <br />(5) year period for use of an existing equipment building; and <br />WHEREAS, North Carolina General Statutes §160A -272 authorizes the <br />County to enter into leases of up to 10 years upon resolution of the Board of <br />Commissioners adopted at a regular meeting after 10 days public notice; and <br />WHEREAS, the required notice has been published and the Board of <br />Commissioners is convened in a regular meeting. <br />THEREFORE, THE CABARRUS COUNTY BOARD OF COMMISSIONERS RESOLVES THAT: <br />The Board of Commissioners hereby approves a nonexclusive lease of the <br />County property described above to Cellco Partnership dba Verizon Wireless <br />for up to ten (10) years and directs the County Manager to execute any <br />instruments necessary to effectuate the lease. <br />Adopted this the 21' day of April, 2014. <br />/s/ Elizabeth F. Poole, Chairman <br />Board of Commissioners <br />ATTEST: <br />/s/ Megan Smit <br />Megan Smit <br />Clerk to the Board <br />(F -4) County Manager - Revised Proposed Calendar - 2014 General Obligation <br />Bonds Referendum <br />On March 17, 2014, the Board of Commissioners voted to allow Kannapolis <br />City Schools (KCS) to decide by May 31, 2014 whether they want to remain on <br />the bond referendum or want to withdraw their resolution and be placed on <br />short term financing in FY 2015. In order to allow KCS enough time to make <br />their decision, the bond schedule needs to be revised as attached. This will <br />move the Board's first introduction of the bond order from May 19, 2014 to <br />July 21, 2014. The revision of the schedule will not prohibit the referendum <br />from taking place in November as planned. <br />UPON MOTION of Commissioner Oesterreich, seconded by Vice Chairman <br />Burrage and unanimously carried, the Board adopted the revised bond schedule. <br />The Bond schedule is as follows: <br />CABARRUS COUNTY, NORTH CAROLINA <br />PR020SED CALENDAR - 2014 GENERAL OBLIGATION BONDS REFERENDUM <br />Date Event <br />NLT 05/23/14 Pre - application conference with Local <br />Government Commission (LGC). <br />NLT 06/13/14 <br />School Board (s) and RCCC submit <br />petition(s) to Board to hold referendum <br />on school and community college bonds. <br />06/16/14* Board of Commissioners (the "Board ") <br />(This action establishes maximum authorization to proceed; Resolution <br />
