April 21, 2014 (Regular Meeting) <br />Page 1995 <br />UPON MOTION of Commissioner Oesterreich, seconded by Vice Chairman <br />Burrage and unanimously carried, the Board approved and adopted the Cabarrus <br />County Emergency Operations Plan as presented. <br />(F -7) Finance - Forest Park Elementary Deed Transfer to Kannapolis City <br />Schools <br />Forest Park Elementary School was built and financed with general <br />obligation and state bonds in 1998. A new wing addition was built and <br />financed with general obligation bonds in 2006. The title to the Forest Park <br />Elementary School property was held in the County's name to allow <br />reimbursement of sales tax paid on the construction projects. Since <br />construction has now been completed, it has been requested to transfer the <br />title of Forest Park Elementary School to the Kannapolis City Schools Board <br />of Education. The special warranty deed has been prepared by the attorney <br />for Kannapolis City Schools Board of Education, reviewed our County Attorney <br />and enclosed. <br />UPON MOTION of Commissioner Oesterreich, seconded by Vice Chairman <br />Burrage and unanimously carried, the Board approved the deed transfer of the <br />Forest Park Elementary School property to the Kannapolis City Schools' Board <br />of Education and authorized the Chairman to sign the deed on behalf of the <br />County. <br />(F -B) Tax Administration - Refund and Release Report - March 2014 <br />Release report contains taxpayers` names, bill numbers, valuations, tax <br />amounts, along with the justifications for releasing the valuation /tax <br />amounts for outstanding levies in accordance with N.C.G.S. 105 -381. Refund <br />report is a summary sheet which lists data from each refund request form, <br />along with the justification for the refunds to the taxpayers in accordance <br />with N.C.G.S. 105 -381. Note: Due to the transition of motor vehicles onto <br />the new North Carolina Vehicle Tax System (NCVTS), motor vehicle- related <br />refunds and releases will begin to be displayed on the new report generated <br />by NCVTS. <br />UPON MOTION of Commissioner Oesterreich, seconded by Vice Chairman <br />Burrage and unanimously carried, the Board approved the March 2014 Refund- <br />Release report, along with the NCVTS Refund report, as submitted and granted <br />authority to the Tax Collector to process the refunds and releases. The <br />report is hereby incorporated into the minutes by reference and is on file <br />with the Clerk to the Board. <br />(G) NEW BUSINESS <br />(G -1) Planning and Development - Proposed Text Amendments to Zoning <br />Ordinance (TEXT2014- 00001 and TEXT2014- 00002) - Public Hearing 6:30 P.M. <br />Susie Morris, Planning and Zoning Manager, presented a request for <br />proposed text amendments to Chapters 6 and 7 of the Zoning Ordinance. She <br />advised the purpose of the proposed amendments to Chapter 6 is to make <br />corrections and updates to the language in general, to update references to <br />the North Carolina State Building Code, to clarify how modified setbacks are <br />determined and to codify how setbacks are determined on corner lots. The <br />purpose of the proposed amendments to Chapter 7 is to remove references to <br />the Adequate Public Facilities Ordinance (APFO). The APFO is no longer a <br />part of the zoning ordinance. She stated the Planning and Zoning Commission <br />voted unanimously on November 12, 2013 (Chapter 6) and March 11, 2014 <br />(Chapter 7) to forward these amendments to the Board of Commissioners for <br />final consideration. She further stated a public hearing is required. <br />Chairman Poole opened the public hearing at 9:35 p.m. The Public <br />Hearing Notice was published on April 9 and 16, 2014 in The Independent <br />Tribune. The Public Hearing Notice was also posted on the County's website <br />( www.cabarruscounty.us ) on April 9, 2014 in accordance with Article 2, <br />Administration, Section 2.1 (Use of Electronic Means to Provide Public <br />Notices) of the Cabarrus County Code of Ordinances. <br />There was no one else present to address the Board; therefore Chairman <br />Poole closed the public hearing. <br />UPON MOTION of Vice Chairman Burrage, seconded by Commissioner Measmer <br />and unanimously carried, the Board approved the proposed text amendments to <br />Chapter 6 and Chapter 7 of the Cabarrus County Zoning Ordinance. <br />Ordinance No. 2014 -08 <br />
