June 16, 2014 (Regular Meeting) Page 2074 <br />(G -1) Planning and Development - Proposed Text Amendment to Zoning Ordinance <br />(TEXT2014- 00004) - Public Hearing 6:30 P.M. <br />Susie Morris, Planning and Zoning Manager, presented a request for a <br />proposed text amendment to the Cabarrus County Zoning Ordinance. She stated <br />the purpose of the proposed text changes to Chapter 7, Performance Based <br />Standards, #67, Temporary Uses, is to clarify standards related to certain <br />temporary uses and the use of recreational vehicles, the waiting period <br />between temporary use permits being issued and to further clarify standards <br />associated with temporary uses that include public assembly. She stated the <br />availability of representatives from the Fire Marshal and Emergency <br />Management offices to answer questions. She also stated a public hearing is <br />required and responded to questions from the Board. <br />Chairman Poole opened the public hearing at 7 :04 p.m. The Public <br />Hearing Notice was published on June 4 and 11, 2014 in The Independent <br />Tribune. The Public Hearing Notice was also posted on the County's website <br />( www.cabarruscounty.us ) on June 4, 2014 in accordance with Article 2, <br />Administration, Section 2.1 (Use of Electronic Means to Provide Public <br />Notices) of the Cabarrus County Code of Ordinances. <br />There was no one present to address the Board; therefore Chairman Poole <br />closed the public hearing. <br />UPON MOTION of Commissioner Messmer, seconded by Chairman Poole and <br />unanimously carried, the Board adopted the following ordinance: <br />Ordinance No. 2D14 -17 <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY <br />ZONING ORDINANCE <br />TEXT2014 -00004 <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as <br />follows: <br />The current Chapter 7 will be REMOVED and REPLACED with the amended Chapter <br />7, which includes revisions to #67, Temporary Uses. <br />REVISE the Table of Contents to correspond to text changes. <br />Adopted this 16th day of June, 2014, by the Cabarrus County Board of <br />Commissioners. <br />/s/ Elizabeth F. Smit, Clerk to the Board <br />G -2) County Manacrer - Participation in NCDOT Private Rail Crossing Closure <br />Jonathan Marshall, Deputy County Manager, stated the North Carolina <br />Department of Transportation ( NCDOT) Rail Division has been working on <br />closing a private crossing over the NC Railroad on the north side of <br />Harrisburg Elementary School. The current proposal includes construction of <br />an emergency access to the school property and enhanced access to the school <br />park. Some of the new access is planned to be paved, but Harrisburg, <br />Cabarrus County and the private owners have suggested that more of the new <br />access be paved instead of just gravel. The NCDOT has requested local <br />participation from Harrisburg and the County in the amount of $10,000.00. <br />The Town of Harrisburg has declined to participate because they will be <br />maintaining that road and feel they have an ongoing cost with that. He <br />advised if it is the Boards' wish to participate, a budget amendment needs to <br />be adopted with funding to come from the Boards' Contingency. <br />Commissioner Measmer expressed his intent, stating he did not think the <br />County should participate. <br />A discussion ensued with Mr. Marshall responding to a variety of <br />questions from the Board. Issues addressed included: the gravel private <br />road the family currently uses; Harrisburg will maintain the road up to the <br />maintenance building; the family will be responsible for road maintenance <br />from the maintenance building as well as the road on their property; the road <br />
