August 18, 2014 (Regular Meeting) Page 2145 <br />Note: Due to the transition of motor vehicles onto the new North <br />Carolina Vehicle Tax System ( NCVTS), motor vehicle - related refunds and <br />releases will begin to be displayed on the new report generated by NCVTS. <br />UPON MOTION of Vice Chairman Burrage, seconded by Commissioner Morris <br />and unanimously carried, the Board approved the July 2014 NCVTS Refund report <br />as submitted and granted authority to the Tax Collector to process the <br />refunds and releases. The report is hereby incorporated into the minutes by <br />reference and is on file with the Clerk to the Board. <br />(G) NEW BUSINESS <br />(G -1) Active Living and Parks - Department Ordinance Related to NCGS 14- <br />415.23 <br />Mike Downs, County Manager, advised a public hearing will be required <br />to amend the ordinance. <br />Lcnda Strong, Active Living and Parks Director, advised North Carolina <br />General Statutes (NCGS) have been amended regarding concealed carry permit <br />holders, allowing those possessing a concealed carry permit to carry guns in <br />parks. She stated there are three areas the governing body can prohibit <br />concealed carry: ball fields, swimming pools and recreation areas. <br />Discussions have been held at Active Living and Parks (ALP) Commission <br />meetings. The ALP Commission made a recommendation the Board of <br />Commissioners limit concealed carry permit holders from carrying into the two <br />specific areas that affect Cabarrus County parks. Concord and Kannapolis <br />have adopted an ordinance prohibiting the concealed carry of firearms in <br />those three defined areas of their parks. Harrisburg has not amended their <br />ordinance yet. She recommended the County's ordinance be updated to reflect <br />statute changes for compliance with new general statutes and be consistent <br />with the municipalities within the county. <br />Chairman Poole questioned the ordinance as it relates to school parks. <br />Richard Koch, County Attorney, advised schools are separately <br />regulated. <br />Ms. Strong advised, in the event an organized school event is being <br />held at a county park, the school's law would take precedence over the <br />County's. <br />A discussion ensued. Items addressed included: signage; consistency <br />among parks; concealed carry classes; etc. <br />Commissioner Oesterreich expressed his intent to vote next month for <br />concealed carry permit holders to be permitted to carry anywhere except where <br />prohibited by law. <br />Discussion continued. <br />UPON MOTION of Commissioner Oesterreich, seconded by Vice Chairman <br />Burrage and unanimously carried, the Board scheduled a public hearing for the <br />September 15, 2014 regular meeting at 6:30 p.m. to consider options for <br />updating Chapter 46 (Offenses and Miscellaneous Provisions) and Chapter 50 <br />(Active Living and Parks) of the Cabarrus County Code of Ordinances. <br />H) APPOINTMENTS TO BOARDS AND COMMITTEES <br />(H -1) Appointments - Adult Care Home Community Advisory Committee <br />Joanne Yurchison's term of appointment on the Adult Care Home Community <br />Advisory Committee ended July 31, 2014. Ms. Yurchison wishes to serve <br />another term. She has served on this board since 2004. An exception to the <br />"length of service" provision of the Appointment Policy will be needed for <br />her. <br />An application has been received from Janet Haywood. She has been <br />prequalified by the Regional Ombudsman and is recommended to be appointed for <br />an initial one -year term. <br />UPON MOTION of Vice Chairman Burrage, seconded by Commissioner Morris <br />and unanimously carried, the Board reappointed Joanne Yurchison to the Adult <br />Care Home Community Advisory Committee for a three -year term ending July 31, <br />2017, including an exception to the ".length of service" provision of the <br />
