January 22, 2013 (Regular Meeting) Page 1393 <br />Susie Morris, Planning and Zoning Manager, reported the North Carolina <br />Supreme Court rendered the final decision in Lanvale v. Cabarrus County. She <br />advised Chapter 15 needs to be removed in its entirety from the Zoning <br />Ordinance as a result of that decision. <br />Chairman Poole opened the public hearing at 7:25 p.m. The Public <br />Hearing Notice was published on January 9 and 16, 2013 in The Independent <br />Tribune. The Public Hearing Notice was also posted on the County's website <br />( www.cabarrus county. us ) on January 8, 2013 in accordance with Article 2, <br />Administration, Section 2.1 (Use of Electronic Means to Provide Public <br />Notices) of the Cabarrus County Code of Ordinances. <br />There was no one present to address the Board; therefore Chairman Poole <br />closed the public hearing. <br />UPON MOTION of Vice Chairman White, seconded by Commissioner Measmer <br />and unanimously carried, the Board approved TEXT 2012 -00003 - Text Amendment <br />to remove Chapter 15 from the Cabarrus County Zoning Ordinance. <br />Ordinance No. 2013 -01 <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY ZONING ORDINANCE <br />TEXT2012 -00003 <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as <br />follows: <br />DELETE Chapter 15, Adequate Public Facilities Ordinance, from the Zoning <br />Ordinance. <br />Adopted this 22n day of January, 2013 by the Cabarrus County <br />Board of Commissioners. <br />/s/ Elizabeth F.
