A copy of these charges and fees will be made <br />available from the Executive Director. <br />3.2 User Charges <br />A user charge shall be levied on all users including, but not limited to <br />persons, firms, corporations or governmental entities that discharge, cause or <br />permit the discharge of sewage into the POTW. <br />(a) The user charge shall reflect at least the cost of debt service, <br />operation and maintenance (including replacement) of the POTW. <br />(b) Each user shall pay its proportionate cost based on volume of flow. <br />(c) The Executive Director shall review annually the sewage <br />contributions of users, the total costs of debt service, operation <br />and maintenance of the POTW and will make recommendations to the <br />Board of Directors for adjustments in the Rate Schedule as <br />necessary. <br />(d) Charges for flow to the POTW not directly attributable to the users <br />shall be distributed among all users of the POTW based upon the <br />volume of flow of the users. <br />3.3 Surcharges <br />All industrial users of the POTW are subject to industrial waste surcharges on <br />discharges which exceed the following levels: <br />BOD - 300 MG /L <br />COD - 675 MG /L <br />TSS - 250 MG /L <br />NH - 15 MG /L <br />Oil /Grease -100 MG /L <br />Aluminum - 1.80 MG /L <br />Arsenic - 0.003 MG /L <br />Cadmium - 0.003 MG /L <br />Copper - 0.090 MG /L <br />Chromium - 0.020 MG /L <br />Cyanide - 0.041 MG /L <br />Lead - 0.049 MG /L <br />Mercury - 0.0003MG /L <br />Nickel - 0.021 MG /L <br />Silver - 0.005 MG /L <br />Zinc - 0.176 MG /L <br />The amount of the surcharge will be based upon the volume of flow and the <br />character and concentration of the constituents of the wastewater discharged in <br />excess of the levels listed above. An industrial user shall never increase the <br />amount of water to dilute pollutant concentrations to avoid or reduce <br />surcharges. <br />(a) The volume of flow used in determining the total discharge of wastewater <br />for payment of user charges and surcharges shall be based on the <br />following: <br />(1) Metered water consumption as shown in the records of meter readings <br />maintained by WSACC. If a person discharging wastewater into the <br />public sewers produces evidence to the Executive Director that a <br />significant percent of the total annual volume of water used for <br />all purposes does not reach the public sewers, then an estimated <br />percentage of total water consumption to be used in determining <br />non - domestic wastewater discharge may be agreed upon between the <br />Executive Director and the person discharging such non - domestic <br />wastewater into the public sewer. The Executive Director shall <br />ascertain whether substantial evidence has been provided to prove a <br />significant percent of water does not reach the public sewers; or <br />(2) If required by WSACC or at the individual discharges option, other <br />flow monitoring devices which measure the actual volume of <br />
